Viladecans initially approves the special plan for the protection of local heritage

The Viladecans City Council has initially approved the Special Urban Plan for the Protection and Cataloging of the Municipal Cultural and Environmental Heritage (PEPCV) and has submitted it for public review for one month. The decision was adopted through mayoral decree 2026/5011, dated August 27, 2026, signed by the Acting Mayor, and is published in full in the Official Gazette of the Province of Barcelona on September 18, 2026 (CVE 202610141423, pp. 1-18). The file, processed by the Territorial Planning Area, carries the reference 1/2023/C00249_PSEP.
The document was submitted on April 23, 2026, with entry registry 2026011853 by Josep Maria Fortià Rius, the contractor awarded the plan’s drafting. Prior to provisional approval, the drafter must present a document that complies with the prescriptions of the legal report and the technical report issued on July 24, 2026, by the department of Territory and City, especially the determinations of sections 15, 16, 17, and 18, as well as those deriving from sectoral reports and the allegations formulated.
The processing is framed within article 85.4 of Legislative Decree 1/2010, of August 3, which approves the Revised Text of the Urban Planning Law of Catalonia. The edict is signed, by delegation, by the Deputy Mayor of the Territorial Planning Area, Ricard Calle Martínez, with an electronic signature date of September 15, 2026.
One month to examine the plan and submit allegations
The public information period is one month and begins to count from the last of the mandatory publications. The plan is displayed through three channels:
- full publication in the Official Gazette of the Province of Barcelona;
- one of the most widely circulated municipal or supra-municipal periodic press newspapers;
- the electronic notice and edict board of the electronic office of the Viladecans City Council.
The technical document can be consulted on the municipal website viladecans.cat/ca/planejament-entramitacio. Inquiries can be directed to the telephone number 936351803, with the possibility of a prior appointment with the responsible technician, or to the email planificacio_territorial@viladecans.cat.
Suspension of licenses in two areas
The decree approves the suspension of the processing of urban plans derived from private initiatives, urban management and urbanization projects, and the granting of licenses for subdivision, construction, renovation, rehabilitation or demolition, installation or expansion of activities, the effectiveness of prior communications, and other related authorizations, within the areas graphically delimited in the plans.
- Area A: assets already included in the suspension agreed upon on October 30, 2025, for the MpPGM-PEPCV, with architectural element (EA) and architectural ensemble (CA) codes of protection levels 1 to 4. Validity is maintained until October 30, 2027, without the initial approval starting a new term.
- Area B: assets not included in that agreement but affected by the PEPCV, with EA and CA codes of protection 1. Integral, 2. Conservation, 3. Partial, and 4. Environmental. The suspension lasts for a maximum of two years from the initial approval.
Works derived from the duty of conservation and maintenance of buildings, the minimum works to achieve public health and personal safety requirements, and those necessary to facilitate accessibility and remove architectural barriers are excepted. While the suspension is in effect, instruments may be processed and licenses granted that are compatible with the determinations of the initially approved plan.
Sectoral reports and appeals processes
In accordance with article 85.5, reports are requested from the following bodies:
- Generalitat de Catalunya: Directorate General of Cultural Heritage of the Department of Culture; Sub-directorate of Archaeological and Paleontological Heritage; Sub-directorate General of Museums and Movable Assets; Territorial Environmental Office of Barcelona of the Department of Territory, Housing and Ecological Transition; Secretariat of Territory, Urbanism and Urban Agenda.
- Metropolitan Area of Barcelona: Directorate of Environmental Services.
- Consortium for the Protection and Management of the Natural Spaces of the Llobregat Delta and Consortium of the Baix Llobregat Agricultural Park.
- State Coastal Demarcation.
- AENA: Directorate of Airport Planning and Regulatory Control.
- Ministry of Culture: Directorate General of Cultural Heritage and Fine Arts; and Ministry of Transport and Sustainable Mobility: Sub-directorate General of Airports and Air Navigation.
Against the fourth and fifth sections, relating to the suspension and qualified as qualified procedural acts, a contentious-administrative appeal may be filed directly before the Contentious-Administrative Section of the Court of First Instance of Barcelona within a period of two months. Optionally and previously, a motion for reconsideration may be presented before the same body within a period of one month. The remaining sections are non-qualified procedural acts and do not admit appeals.
The plan henceforth conditions any work, renovation, rehabilitation, or change of use in the cataloged assets of Viladecans and establishes the protection framework for the architectural and environmental heritage of the municipality for the coming years. Affected owners and developers have one month to consult the document and submit allegations or suggestions.
