Valverde de Leganés aprueba el reglamento definitivo de su residencia de mayores

The City Council of Valverde de Leganés has finalized the modification of the Internal Regulations of its mixed residential center and day center, as no claims were filed during the public exhibition period. The full text is published in the Official Gazette of the Province of Badajoz number 207, dated October 28, 2026, under Announcement 4280/2026, signed by the mayor Manuel Borrego Rodríguez. The regulation comes into force with this publication and governs the organization, rights, and duties of residents, day center users, and their families.

The plenary agreement, initially approved and not challenged during the public information process, is published in compliance with article 17.4 of the Recast Text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5. The preamble of the regulation invokes Law 39/2006, of December 14, on the Promotion of Personal Autonomy and Care for People in Situations of Dependency; Law 2/1994, of April 28, on Geriatric Social Assistance of Extremadura, and Decree 298/2015, of November 20, on the Authorization, Accreditation, and Registration of Care Centers for the Elderly. The municipal regulatory power is supported by article 22.2.d) of Law 7/1985, of April 2, Regulating the Bases of the Local Regime.

The center is municipally owned—with direct or indirect management—and serves dependent residents, autonomous residents, and day care users, with the objectives of remaining in the usual environment and providing family respite. The number of places for each group shall be determined by the resolution authorizing opening and operation.

Access requirements and priority on the waiting list

The articles, which extend from article 1 to 37 with an added article 30 bis, establish the conditions for admission:

  • Being 65 years of age, a threshold that drops to 60 in the case of pensioners and may be exceptionally reduced to 50 years for people with disabilities, subject to a report from the municipal social services.
  • Not suffering from behavioral disorders that prevent coexistence and not having been sanctioned with expulsion from another center.
  • Submitting the application to the City Council registry; admission is decided by the Evaluation and Monitoring Commission, except for places reserved by the regional administration.
  • Correcting documentation within 10 business days and occupying the place within 15 calendar days from notification, under penalty of forfeiture of the right.

In the event of similar situations, preference is resolved in favor of residents of Valverde de Leganés with at least two years of seniority —or five years of previous residence—, those native to the municipality, and income through family reunification; dependent spots are assigned in the order in which applications are received.

Rights, duties, and new visiting regime

The second title lists the rights of residents: dignified housing, adequate maintenance with medical care if applicable, assistance according to the type of spot, private communications, participation as a voter and candidate in internal elections, suggestions, and the reservation of a spot for up to two months in case of absence, extendable for health or serious family reasons.

The regulation introduces an article 30 bis specifically dedicated to family members and visitors, which empowers the center’s management to warn, restrict access to the residential area, or expel from the facilities those who violate the rules of coexistence, with the facts being forwarded to the City Council for a potential disciplinary proceeding.

Visits are permitted from 11:00 to 13:00 and from 17:00 to 19:00 hours, with a maximum of two simultaneous visitors per resident. It is prohibited to access rooms without authorization, enter service areas, and use the bathrooms in the rooms; each resident may invite two guests to eat per day, four times a month.

Sanctions, deadlines, and participation bodies

The disciplinary regime distinguishes between minor, serious, and very serious offenses, with suspensions of rights ranging from 7 calendar days to three months or the definitive loss of user status. Infractions expire in two, four, and six months, respectively, and sanctions are executed within ten days of notification.

The General Assembly, composed of residents, guardians, management, and workers with a voice but no vote, meets in an ordinary session once a year within the first semester and extraordinarily at the request of 25% of its members, with ten business days’ notice and a quorum of 10% in the first call. The Evaluation and Monitoring Commission, chaired by the mayor, is convened at least every six months.

An administrative appeal may be filed against the final agreement within two months from the day following the publication of the announcement, before the High Court of Justice of Extremadura based in Cáceres.

The regulation arrives in the Bulletin with a stricter framework for visits and the use of facilities, and incorporates a standardized complaint and suggestion sheet model. For local families, the text sets in writing the economic conditions, schedules, and consequences of non-compliance, and recognizes them as interested parties in the resolution of complaints and the imposition of sanctions.
