Valls initially approves the regulations of the Municipal Commission of Vallencian Heritage

Por FactBox Admin

Valls aprova inicialment el reglament de la Comissió Municipal de Patrimoni Vallenc

The City Council of Valls has initially approved the new Regulations of the Municipal Commission of Vallenc Heritage, the consultative body responsible for reporting on building and activity licenses that affect cataloged assets in the municipality. The agreement was adopted by the Municipal Plenary in the session of October 5, 2026, and is published in the Official Gazette of the Province of Tarragona (BOPT) of October 29, 2026, section I, pp. 1-8, with the official reference CVE 2026-09794. The text is subject to a public information period of 30 business days so that interested parties may examine the file and submit claims and suggestions.

Adaptation to the POUM and protection catalogs

The revision responds to the final approval of the Municipal Urban Planning Plan (POUM) of Valls, published for execution purposes on August 11, 2021, in DOGC no. 8477. The first additional provision of its urban planning regulations obliges the City Council to draft or adapt regulations and ordinances to the current sectoral legislation and the new planning.

The POUM incorporates the Catalog of Farmhouses and Rural Houses and the Catalog of Protected Assets, which determine the intervention mechanisms, uses, and preservation conditions. According to the document, the Catalog of Farmhouses and Rural Houses currently includes:

  • One BCIN (Cultural Asset of National Interest).
  • 47 BCIL (Cultural Assets of Local Interest).
  • One BPU (urban protection asset).
  • 12.14 hectares of Tossal Gros de Miramar, a space included in the PEIN and the Natura 2000 Network as an SCI and SPA.

The text argues that the regulation must be updated to adapt it to this framework and to “facilitate regulatory interpretation” and apply criteria of simplicity and effectiveness in actions on protected assets or spaces.

Mandatory but non-binding reports

The Commission is defined as a collegiate body of a consultative nature, complementary to the municipal organization and without executive powers, with an “eminently technical” vocation. Its report will be mandatory and non-binding in the following matters:

  • The BCIL included in the Architectural Heritage Catalog of the municipality.
  • The granting of building and/or activity licenses that affect any cataloged asset, at any level or protection environment.
  • Public initiative actions that affect cataloged elements or assets.
  • The modification, revision, or expansion of the Catalog of Assets to be Protected.
  • Municipal actions for the protection of heritage and the processing of planning instruments that affect it.

It will also assume functions of revitalization, encouragement, and promotion of the rehabilitation and conservation of architectural, archaeological, and landscape heritage, and may propose the incorporation or decataloging of assets.

Composition and internal operation

The Commission will be chaired by the mayor of Valls, or by the councillor to whom they delegate, and will consist of the following permanent members:

  • One representative for each municipal group.
  • A municipal architect and a municipal legal advisor.
  • One representative from the Institut d’Estudis Vallencs (IEV).
  • One representative from the Official College of Architects of Catalonia in Tarragona (COAC).
  • Three people linked to the heritage of Valls, appointed by the Local Governing Board.
  • The Secretary of the City Council, with voice but without vote.

Experts with voice but without vote may be incorporated when the presidency deems it appropriate. The sessions will not be public, will preferably be held in the Boardroom and may be held remotely, with a regular bimonthly frequency and a minimum notice of 24 hours.

Agreements will be adopted by simple majority, with a casting vote by the presidency in the event of a tie. Proposals that modify the classification of assets will require two-thirds of those present and a minimum of four favorable votes. The minutes will be public and will be published on the municipal website.

Period for allegations and entry into force

The announcement will be made in the BOPT, in the DOGC, in a daily written communication medium, on the municipal electronic office, and on the transparency portal. The period of 30 business days will begin to count the day after the last of the official publications.

If no claims are presented, the initial agreement will become final without the need for a new plenary agreement, and the full text will be published in the BOPT and on the electronic office. The regulation will enter into force the day after the full publication and will repeal the Regulating Regulation of the Local Commission of Vallenc Heritage approved by the Plenary on September 21, 2012, and published in the BOPT no. 234, of October 9, 2012.

The regulation directly affects any owner or developer who wishes to intervene in a protected building in Valls: the Commission’s report becomes a mandatory part of the file, although not binding, and the new text specifies majorities, quorums, and deadlines that until now were not fixed with such detail. The 30 business days of exhibition are the only window to introduce changes before the regulation is definitively approved.
