Valle de Tobalina sets urban planning fees from 30 to 500 euros

The Valle de Tobalina City Council has made final the provisional plenary agreement to modify the fiscal ordinance regulating the fee for the granting of urban and environmental activities, as no claims were filed during the public exhibition period. The regulation is published in the Official Gazette of the Province of Burgos number 165, dated September 1, 2026, with reference BOPBUR-2026-03638.

The ordinance is issued using the powers granted by articles 133.2 and 142 of the Constitution and article 106 of Law 7/1985, of April 2, regulating the Bases of Local Regime, and complies with the consolidated text of the Law regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5. The full text is made public in compliance with article 17.4 of said regulation and enters into force the day following its publication.

Fees according to the type of action

The fee taxes the municipal, technical, and administrative activity aimed at verifying that building and land-use acts comply with the urban and police regulations of the municipality, in accordance with Law 5/1999, of April 8, on urbanism of Castilla y León, and Law 11/2003 on environmental prevention. The tax quotas are fixed as follows:

• €30.00: communicated action or responsible declaration for minor works.
• €60.00: major works, major works license, first use of buildings, and modification of use.
• €150.00: urban subdivisions, segregation and aggregation of estates, and demolition of constructions.
• €50.00: advertising signs visible from public roads.
• €200.00: authorizations for the use of rural land, activity and opening licenses.
• €500.00: approval of planning instruments.
• €30.00: urban planning reports at the request of a party without an inspection visit.
• €60.00: urban planning reports with an inspection visit and demarcation of alignments and gradients.

In the event of withdrawal prior to the granting of the license, the quotas are reduced by 50 percent if the municipal activity has already begun. License extensions incur a surcharge of 5, 10, and 15 percent on the first, second, and third extension, respectively.

Bonuses for energy efficiency

The ordinance does not provide for any exemption from the collection of the fee, but it does establish two bonuses on the quotas:

• 90% for work units directly related to the removal of architectural barriers.
• 50% for constructions and installations that incorporate thermal or electrical solar energy utilization systems for self-consumption or energy efficiency measures, provided that a technical report certifies a reduction of at least 30% in the consumption of non-renewable primary energy.

Additionally, if legislation requires the insertion of advertisements in official bulletins, their cost will be added to the indicated amounts, for which the applicant will be required to provide a financial guarantee of €300.00 at the start of the proceedings. Processing with other public administrations adds €40.00.

Accrual, management, and appeals

The fee accrues when the municipal activity begins, which is understood to be the date the license application is submitted. If works are carried out without a license, the fee accrues when the activity leading to the determination of whether the work is authorizable begins. The settlement is carried out once the license is granted, and in the case of planning instruments, at the time of their final approval.

The ordinance expressly repeals the second additional provision of the ordinance on the tax on constructions, installations, and works published in the Official Provincial Gazette number 242, of December 23, 2013. An administrative-law appeal may be filed against the agreement before the Administrative Litigation Chamber of the High Court of Justice of Castilla y León based in Burgos, within two months of publication. The agreement was signed on August 19, 2026, by the mayor-president, Jesús Ángel López de Mendoza Ochoa.

The entry into force of this fee directly affects developers, builders, and residents planning works or activities in the municipality, who must budget for these costs and may benefit from bonuses linked to energy sustainability.
