Vadocondes approves the fee for the occupation of public domain

The Vadocondes City Council has finalized the fiscal ordinance regulating the tax for the occupation of public domain by stalls, booths, sales kiosks, shows, attractions or recreation, street industries, and street vendors. The agreement, adopted by the Plenary in the session of July 20, 2026, is published in the Official Gazette of the Province of Burgos number 174, dated September 14, 2026, with reference BOPBUR-2026-03781.
As no claims were filed during the public exhibition period, the provisional agreement was automatically elevated to final status, in accordance with article 17.4 of the consolidated text of the Law regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5. The ordinance enters into force on the day of its publication and shall remain in effect until its express modification or repeal. The announcement is signed by the mayor, Luis Javier Herrera Martín, dated September 2, 2026.
Rates by activity
The tax quota consists of a fixed amount determined according to the activity utilizing the public domain. The rates are established as follows:
- Food and beverage stalls: 50 euros/day
- Food trucks: 50 euros/day
- Recreational games (bowling, shooting, and similar): 40 euros/day
- Kiosks for the sale of toys, accessories, and similar: 15 euros/day
- Circus shows or analogous: 70 euros/day
- Attractions such as trampolines, inflatables, and similar: 70 euros/day
- Bumper cars, kart tracks, and similar: 170 euros/day
- Tents for weddings and other private events: 150 euros/event
The Mayor’s Office may rule on the application of analogous rates for activities not expressly provided for in the ordinance.
Exemptions and management
Activities organized directly by the Vadocondes City Council, those promoted by the State, the autonomous community, the Provincial Council, or other public administrations, as well as those declared of general, cultural, social, or charitable interest by the city council itself, are exempt from payment of the tax.
The tax accrues from the moment the municipal authorization is granted or from the moment the effective occupation of the public domain occurs if it is carried out without authorization. Payment must be made prior to occupation, via self-assessment and deposit into the Treasury, which may be done through bank transfer. The authorization may be conditioned upon compliance with security, cleaning, and respect for the urban environment measures.
Obligations and appeals
When the occupation entails the destruction or deterioration of the local public domain, the beneficiary shall be obliged, in addition to the payment of the fee, to reimburse the total cost of reconstruction or repair expenses and to make a prior deposit of said amount. If the damages are irreparable, the entity shall be indemnified for the value of the destroyed assets, and such indemnities may not be waived in whole or in part.
An administrative appeal may be filed against the agreement before the Administrative Chamber of the High Court of Justice of Burgos, within a period of two months from the day following the publication of the announcement, in accordance with Article 46 of Law 29/1998, of July 13, on Contentious-Administrative Jurisdiction.
The new ordinance provides legal certainty to fairground operators, street vendors, and event organizers operating in the municipality, while guaranteeing the city council a stable source of income and a clear framework of obligations and responsibilities regarding the use of public space.
