Urban Planning replaces private execution with compulsory execution in Barranco Grande

The Governing Council of the Municipal Urban Planning Management of Santa Cruz de Tenerife has declared the breach of urban planning duties inherent to the private execution system in the Action Unit UA-SO.15, Barranco Grande, Southwest area (File SO-4), and has agreed to replace that system with the forced execution system. The decision, adopted in a session held on July 10, 2026, under file no. 1984/2022, is published in the Official Gazette of the Province of Santa Cruz de Tenerife number 102, dated August 26, 2026, via announcement 1749966.

The agreement is adopted under article 115.4 of the Management and Execution Regulations of the Planning of the Canary Islands, which enables the publication of the agreement when the breach of urban planning duties is verified. The pending action consists of the formulation, processing, and approval of the reparceling project of the unit, as well as the materialization of the mandatory transfers derived from the planning and the Urban Planning Agreement signed on July 30, 2004.

Breach by the owners

The governing body considers that the owners included in the scope of the unit have breached their obligations by failing to formulate, present, or process the corresponding reparceling project in accordance with the current urban planning and the signed agreement. This breach has prevented the completion of the urban planning management of the action, the legal regularization of the affected estates, and the materialization of the mandatory transfers in favor of the City Council of Santa Cruz de Tenerife.

The pending transfers include:

  • land destined for roads, open spaces, and public facilities;
  • 3,409.04 m² of buildability corresponding to 10% of the urban development potential;
  • 1,265.44 m² of buildability corresponding to the compensation derived from the excess urbanization costs assumed by the Administration.

Forced execution and costs

Secondly, the agreement replaces the private execution system with the public forced execution system, such that the municipal Administration will proceed subsidiarily to complete the pending urban planning management on behalf and at the expense of the affected owners. The estimated economic quantification of the ordinary management obligations derived from the preparation and processing of the reparceling project is provisionally set at TWENTY-SIX THOUSAND TWO HUNDRED AND TWENTY EUROS (€26,220.00).

The agreement further orders the notification of the resolution to the affected owners and other interested parties, and its communication to the Property Registry for the purposes provided for in article 113.3 of the Management and Execution Regulations of the Planning of the Canary Islands.

Appeals and administrative route

The agreement concludes the administrative process. The following appeals may be filed against it:

  • Optional Appeal for Reversal (Recurso Potestativo de Reposición) before the Plenary of the Municipal Corporation within one month of notification;
  • or directly a Contentious-Administrative Appeal within two months of notification.

Against the express decision of the appeal for reversal, a contentious-administrative appeal may be filed before the Contentious-Administrative Section of the competent Court of First Instance of Santa Cruz de Tenerife, within two months of the express notification.

The substitution of private execution with forced execution represents a decisive step toward unblocking the urban management of Barranco Grande, a residential area in the southwest of the Tenerife capital that has had a pending land redistribution (reparcelación) for more than two decades. The decision transfers the cost of the works and pending obligations to the owners and directly affects the regularization of the properties and the neighbors of the area, who will see the completion of the transfers of roads, open spaces, and committed facilities.
