Un taxista de Sevilla pleitea poder transmitir su licencia a una sociedad

The Taxi Institute of the Seville City Council has forwarded to the Seville Court of First Instance the administrative file of the appeal filed by a city taxi driver to be able to transfer his license to a limited liability company. The referral was agreed upon by Resolution of the President of the Taxi Institute No. 327, dated October 29, 2026, and is made public via edict in the Official Gazette of the Province of Seville (BOP) No. 213, dated Wednesday, November 4, 2026, with the official reference CVE: BOP-SE-2026-213022.

The appeal, registered as Ordinary Procedure 318/2026, was filed by Manuel Domínguez Romero against the presumed dismissal by administrative silence of the requests he addressed to the Taxi Institute. In those requests, he sought the recognition of the right to transfer his taxi license to a limited liability company. Jurisdiction over the matter corresponds to the Administrative Litigation Section of the Seville Court of First Instance, Plaza No. 1.

The body processing the file depends on the Area of Public Safety, Mobility, and Human Resources of the City Council, through the Delegation of Mobility and the General Directorate of Mobility. The edict is signed by the Head of Service of the Taxi Institute, Rocío Domínguez López, with an electronic signature stamp dated October 29, 2026, and spans one page within the provincial gazette.

Summons to interested parties

The publication of the edict does not resolve the merits of the case, but rather fulfills a mandatory procedural step: to make the existence of the proceedings known to those who may have an interest in them. The Taxi Institute acts “in accordance with the orders of the judicial body and Article 49 of Law 29/1998, of July 13, regulating the Administrative Litigation Jurisdiction.”

The text establishes the conditions for this appearance:

  • Deadline: nine days to appear in the proceedings.
  • Body before which to appear: the Administrative Litigation Section of the Seville Court of First Instance, Plaza No. 1.
  • Consequence of not appearing: the proceedings will continue without any notification of any kind being issued to the interested parties.
  • Administrative act triggering the publication: Resolution of the President of the Taxi Institute No. 327, dated October 29, 2026.

What is being disputed: the ownership of the license

The object of the litigation is a matter of practical scope for the sector: whether a taxi license holder can or cannot transfer it to a legal entity, in this case, to a limited liability company. The municipal administration did not respond expressly to the appellant’s requests within the legal timeframe, resulting in a presumed dismissal by administrative silence, and it is this inactivity that has brought the matter before the contentious-administrative jurisdiction.

The controversy is therefore posed on two linked levels: first, whether the silence should be understood as a refusal of the requested transfer; second, whether the regulations applicable to the taxi service allow the license to leave the sphere of a natural person to end up in the hands of a commercial company.

Why it matters to the sector

The judicial resolution issued in due course will affect the way taxi operations are organized in the city and the asset value that holders attribute to their licenses. If the transfer to limited companies is recognized, the door opens to corporate exploitation formulas and purchase-sale operations that have been blocked until now; if the refusal is confirmed, the personal link between the holder and the license is consolidated.

While the procedure progresses, the ball is in the court of the Court of First Instance of Seville, which already has the complete administrative file sent by the Taxi Institute. The publication in the BOP of Seville on November 4, 2026, marks the starting point of the nine-day period for any interested party in the sector to appear and defend their position in a lawsuit that could redefine the rules of the game for the Sevillian taxi.
