Ubrique approves its new Municipal Traffic and Circulation Ordinance

The Plenary of the Ubrique City Council definitively approved, at its session of July 29, 2026, the Municipal Traffic and Circulation Ordinance of the Hon. Ubrique City Council, whose final approval is published in the Official Gazette of the Province of Cádiz in the announcement of the local entity, in accordance with the provisions of articles 70.2 of Law 7/1985, of April 2, Regulating the Bases of Local Government.

The regulation responds to the need to adapt municipal regulations to current state legislation, in particular to Royal Legislative Decree 6/2015, of October 30, which approves the Consolidated Text of the Law on Traffic, Motor Vehicle Circulation and Road Safety, which attributes to municipalities powers over the management and control of traffic on urban roads under their ownership.

Purpose and scope of application

The purpose of the ordinance is to regulate the circulation of vehicles and people on the urban roads of the municipality of Ubrique, as well as other uses and activities on roads and public spaces, making the equitable distribution of parking among all users compatible with the necessary flow of vehicular traffic and with the pedestrian use of streets.

The scope of application extends to the entire municipality of Ubrique and is binding on owners and users of urban public roads and land suitable for circulation, as well as on those roads and land that, although not suitable for this purpose, are for common use.

Regulation of PMVs, bicycles and pedestrians

The ordinance establishes a specific Title Four dedicated to pedestrians, bicycles and personal mobility vehicles (PMVs), with separate chapters for each of these groups. Regarding speed, a general limit of 30 km/h is established on urban roads in Ubrique, with the possibility of lower reductions in pedestrian areas, the old town and streets with high pedestrian traffic.

As for PMVs, the maximum speed limits are:

• 15 km/h on sidewalk-bike lanes and cycle paths.
• 25 km/h on all other cycle lanes.
• 20 km/h in areas with restricted access to traffic and in zone 20 or single-platform areas.

The ordinance expressly prohibits PMV drivers from traveling on roads restricted to traffic, traveling without an approved helmet, without reflective clothing between dusk and dawn, or using audio headsets or earphones connected to sound devices. It is also prohibited to travel with two or more people on the same PMV.

Registration, parking and rental of PMVs

The regulation provides for the possibility that the Ubrique City Council creates a Municipal Registry of PMVs, in which case persons over 15 years of age —accompanied by their father, mother, or legal guardian— may register their vehicles by providing personal data, serial number or chassis number, make, model, color, and insurance policy.

Parking of PMVs must be carried out in areas designated for bicycle parking, provided that their dimensions allow it. Tying PMVs to trees, traffic lights, lampposts, benches, traffic sign posts, containers, or litter bins is prohibited.

With regard to companies whose economic activity is dedicated to the rental of PMVs, bicycles, or cycles for tourist or leisure purposes, they must previously obtain a temporary administrative authorization, either directly or through public tender, and provide supporting documentation, civil liability insurance, safety measures, and technical documentation for each vehicle.

Sanctioning regime

Infractions are classified as minor, serious, and very serious. The fines provided for are:

• Up to 100 euros for minor infractions.
• Between 101 and 200 euros for serious infractions.
• Between 201 and 500 euros for very serious infractions, with the exception of certain conduct.
• Between 500 and 1,000 euros in cases of driving under the influence of alcohol or drugs.
• 1,000 euros fixed in cases of driving with the presence of drugs in the body.

Responsibility for infractions shall fall directly on the person committing the act, except in the case of minors under 18 years of age, in which case their parents, guardians, or legal custodians shall be jointly and severally liable.

Entry into force

The ordinance shall enter into force fifteen working days after its full publication in the Official Bulletin of the Province of Cádiz, in accordance with article 70.2 of Law 7/1985. The traffic sanctioning procedure is delegated to the Provincial Collection and Tax Management Service of the Provincial Council of Cádiz, with which the Ubrique City Council maintains a current agreement for the management of traffic fines.

The approval of this ordinance represents a comprehensive update of municipal road regulations, repealing previous rules of the same rank that oppose, contradict, or fail to properly develop its content, and providing Ubrique with a complete legal framework for traffic management in a context of growing presence of PMVs and new forms of urban mobility.
