UARIV transfers the management of the Victims' Fund to the Secretary General

The Special Administrative Unit for Comprehensive Attention and Reparation to Victims (UARIV) modified the delegation of contractual competence and expenditure authorization of the Victims’ Reparation Fund, transferring it from the Head of the Legal Advisory Office to the position of Secretary General. The decision, adopted through Resolution number 03001 of 2026 on September 1, was published in the Official Gazette number 53,613 on Wednesday, September 2, 2026, pages 43 to 45.

The regulation, signed in Bogotá on August 28, 2026, by the Acting Director General Erik Alejandro Herrera Yepes, partially modifies Resolution number 02028 of September 3, 2025, which had unified and updated the entity’s delegations. The change seeks to harmonize the exercise of delegated competencies with the organic functions of the General Secretariat regarding financial and contractual matters, and the Reparation Directorate regarding administrative and judicial compensation.

Reassignment of contractual competence

Article 1 of the resolution delegates to whoever holds the position of Secretary General of the UARIV the competence to contract, commit resources, and authorize expenditure on behalf of the entity in technical and mission-related matters, regardless of the nature, amount, or selection modality. The delegation includes, among other powers:

  • Authorizing expenditure, committing resources, and entering into the contracts and agreements required by the entity.
  • Issuing and signing the acts of the expenditure authorizer during the planning, selection, contracting, execution, and liquidation stages.
  • Entering into, adding to, extending, modifying, suspending, terminating, and liquidating contracts and agreements, and approving guarantees and assignments.
  • Appointing and replacing supervisors of contracts and agreements.
  • Authorizing expenditure derived from public trust contracts and fiduciary assignments for the administration of UARIV resources.

The Legal Advisory Office retains its functions of advisory, review, and legal support, as well as the delegation to decide on fines, penalty clauses, breach of contract, and expiration.

Fund Coordination and payment of compensations

Article 2 delegates to the advisor Code 1020 Grade 15 the Coordination of the Reparation Fund of the Unit for Comprehensive Attention and Reparation to Victims, as provided in Resolution number 1606 of 2025. This coordination comprises the authorization of expenditure and contracting in technical and mission-related matters regarding the Fund, and includes:

  • The administration of the Victims’ Reparation Fund, including contracting, expenditure authorization, and payment in its name.
  • The payment of judicial indemnities contained in justice and peace sentences and the commercialization of administered assets, in accordance with articles 54 and 55 of Law 975 of 2005, article 177 of Law 1448 of 2011, and Decree number 1069 of 2015.
  • The legal representation of the Fund in co-ownership assemblies, the acquisition or transfer of assets, the final disposal of assets, and the signing of insurance policies.

Indemnities ordered by the Inter-American Court

Article 3 modifies article 10 of Resolution 02028 of 2025 and delegates to the Reparation Directorate of the UARIV the competence to authorize expenditure, including the recognition and payment of indemnities ordered by the Inter-American Court of Human Rights in its judgment of July 27, 2022. The delegation extends to the authorization of expenditure for the operation, per diems, and commissions of the Monitoring Commission for the compliance of the ruling in the Unión Patriótica case, in line with Decree number 1643 of 2023, which tasked the UARIV with the execution of resources to comply with orders 25 and 38 of that judgment.

The measure directly affects the execution of reparation resources for victims of the armed conflict by concentrating the contractual and financial management of the Fund in the General Secretariat and the payment of judicial and international indemnities in the Reparation Directorate, in order to guarantee the traceability of decisions and the coordination between contractual planning, budget availability, and the execution of resources.
