Tributación abre consulta pública sobre debida diligencia del estándar CRS

The General Directorate of Taxation has opened a ten-business-day public consultation period regarding the draft “Resolution on Due Diligence for the Provision of Information corresponding to the Standard for the Automatic Exchange of Financial Account Information: COMMON Reporting Standard (CRS)”. The notice is published in La Gaceta No. 188 on Tuesday, October 6, 2026, in the Miscellaneous Documents section, under official reference IN202601130180, and was signed by the Director General of Taxation, Miguel Ángel Solís Sánchez, on September 29, 2026.

The notice is issued based on the second paragraph of Article 174 of the Code of Tax Norms and Procedures, a regulation that mandates submitting draft general provisions for public consultation prior to their issuance. The call is addressed to entities representing general, corporate, or diffuse interests, which may express their views on the proposed text.

The project refers to the due diligence applicable to the provision of information corresponding to the international standard on financial accounts, known by its English acronym CRS (Common Reporting Standard). This is the instrument that mandates the identification of accounts and the reporting of financial information for the purposes of automatic exchange between tax administrations.

What is being submitted for discussion

The object of the consultation is the draft resolution that develops the due diligence for the provision of information included in the CRS standard. The notice does not detail the articulated content of the project, which must be consulted via the link enabled by the Ministry of Finance during the ten-business-day period.

The General Directorate of Taxation is the department of the Ministry of Finance responsible for the administration and collection of taxes, and acts in this process as the competent tax authority.

Background of the standard in the country

Costa Rica’s link to the automatic exchange of financial information is documented in the ordinary and extraordinary budget project of the Republic for the 2027 economic year, published in Scope No. 117 of La Gaceta No. 168 on September 7, 2026. That document records the payment of the membership fee for the Convention on Mutual Administrative Assistance in Tax Matters and the Multilateral Competent Authority Agreement for the Automatic Exchange of Financial Account Information and Exchange of Country-by-Country Reports (CRS and CBC MCAA), according to the Declaration on Automatic Exchange of Financial Account Information of 06/03/2015 and the Declaration on the Multilateral Competent Authority Agreement for the Exchange of Country-by-Country Reports of 01/27/2016.

The mechanism of article 174 of the Tax Norms and Procedures Code has already been used in recent weeks: in La Gaceta No. 175 of September 17, 2026, an equivalent notice was published for the draft reform of Resolution No. MH-DGT-RES-0048-2025, regarding the informative declaration form for withholdings on credit and debit card operations.

The timeframe is short and runs from the first publication of the notice, meaning that interested sectors—particularly financial system entities and their representatives—have a narrow window to influence the final text of a regulation that will mandate the capture and reporting of financial account information under the CRS standard.
