Torroella suspends acoustic quality during the Festa Major

The Torroella de Montgrí City Council has agreed to provisionally suspend acoustic quality objectives during the Sant Genís Main Festival 2026, which takes place from August 22 to 26. The measure, approved via mayoral decree no. 2915 of August 10, 2026, is published in extract in the Official Gazette of the Province of Girona (no. 160, August 20, 2026, edict 7419, reference BOP-2026_0_160_7419).
The suspension exclusively affects the areas, days, and time slots where concerts, correfocs (fire-runs), fair attractions, and other festival events are held, and is exceptional, provisional, and territorially and temporally limited in nature. Outside of these spaces and schedules, the acoustic quality objectives and the rest of the current regulations remain fully applicable.
Legal framework and processing
The resolution is based on Article 9.1 of Law 37/2003, of November 17, on noise, and Article 20 bis of Law 16/2002, of June 28, on protection against acoustic pollution, which allow municipalities to temporarily suspend acoustic quality objectives for traditional, holiday, and cultural events of special deep-rootedness and social interest. The regulatory framework is completed by Decree 176/2009, of November 10, which approves the Regulation of Law 16/2002.
The decision is supported by the technical report on the acoustic impact of the festival, issued on July 30, 2026, by the municipal technical engineer and identified by number SEFYCU 254941. The decree, signed by Jordi Oliver González on August 17, 2026, was issued in the exercise of the powers delegated by the Mayor’s Office via decree no. 3357/2023, of June 20, 2023.
Affected areas and time slots
The suspension applies to a set of spaces in the municipality during the days of the main festival:
- Ter River Parking: fair attractions, from August 22 to 26, from 6:00 PM to 3:00 AM the following day.
- Stall area: bar, dinners, and concerts, on August 22, 23, 24, and 26, from 11:00 PM to 5:00 AM the following day.
- Plaça de la Vila: traditional dances and proclamation (August 22, 8:00 PM-10:00 PM) and correfoc (August 22, 10:00 PM-12:30 AM).
- Plaça de la Muralla and Passeig de l’Església: children’s correfoc, August 23, from 8:00 PM to 10:00 PM.
- Espai Jove Courtyard: stall pre-parties, on August 23, 24, and 25, in afternoon and night slots.
- John Lennon Gardens: popular dinner with havaneres (August 24, 9:00 PM-1:30 AM), afternoon concert (August 25 and 26, 7:00 PM-9:00 PM), and dance with orchestra (August 25 and 26, 10:00 PM-12:30 AM).
- Augustinian Convent and surroundings: “explosive vermouth,” August 26, from 12:00 PM to 2:00 PM.
- Itinerant route: cercavila (August 25 and 26) and the Nocturna (August 26, 10:00 PM-2:00 AM).
Scope and guarantees of the suspension
The suspension does not exempt compliance with the rest of the applicable regulations regarding public shows, recreational activities, security, fire prevention, pyrotechnics, public health, occupation of public roads, and citizen coexistence. Nor does it cover sound emissions unrelated to the ordinary development of the festa major events.
The competent municipal Technical Services in matters of acoustic pollution will carry out the technical monitoring of the established conditions and determine the necessary measures to minimize the acoustic impact of the affected events. Outside the spaces, dates, and time slots expressly indicated, the acoustic quality objectives and the rest of the determinations of the current regulations are fully applicable.
Appeals and effects
The resolution, which exhausts the administrative route, takes effect from its publication in the BOP of Girona. An optional appeal for reversal may be filed before the same body within one month, or a contentious-administrative appeal may be filed before the Contentious-Administrative Court of Girona within two months, in accordance with laws 39/2015 and 29/1998.
The measure allows the festa major of Torroella de Montgrí, one of the most deeply rooted traditional manifestations in the municipality, to develop normally during the days of maximum activity, although residents and attendees will have to coexist with higher levels of acoustic emission in specific areas and schedules. The suspension, however, remains strictly delimited to prevent it from becoming a general exemption from noise protection regulations.
