Torrecilla en Cameros definitively approves the ordinance for driveway licenses

Entry into Force of Local Regulations

The Official Gazette of La Rioja number 156, published on Monday, August 17, 2026, contains the final approval of the ordinance regulating driveway licenses and vehicle access through sidewalks or public domain property of the Torrecilla en Cameros City Council. The full text of the regulation, seven pages long, appears in Section III (Other provisions and acts) with the official reference BOR-A-20260817-III–3218 and file number 202608130123969.

The ordinance enters into force in accordance with the provisions of Articles 70 and 65.2 of Law 7/1985, of April 2, Regulating the Bases of Local Government, once its full text has been published in the official gazette.

Approval Procedure

The Plenary of the Torrecilla en Cameros City Council initially approved the ordinance at an ordinary session held on June 29, 2026. Subsequently, the text was published in the Official Gazette of La Rioja number 124, of July 2, 2026, for public consultation.

During the objections period, no objections were submitted by residents or interested parties, so the agreement was elevated to final approval in accordance with Article 17.3 of Royal Legislative Decree 2/2004. The final publication is now formalized, on August 14, 2026, with the signature of the Mayor-President, Sergio Martínez Astola.

Scope and Content of the Ordinance

The regulation establishes a comprehensive framework for regulating driveways in the Riojan municipality. The ordinance is structured into five chapters and 31 articles covering everything from general provisions to the regime for extinguishing licenses.

• Concept of driveway: defined as the special use of public domain consisting of the entry and exit of vehicles from properties, premises, or plots through sidewalks, pedestrian areas, or municipal public domain property.
• Types of license: permanent driveway (24 hours), scheduled or working-hours driveway (only during authorized hours), and construction driveway (temporary for construction machinery).
• Competent body: the granting, modification, transfer, revocation, and extinguishment corresponds to the Mayor’s Office-Presidency.
• Requirements: urban planning compatibility, absence of risks to road or pedestrian safety, sufficient space for maneuvers, and being up to date with municipal tax obligations.
• Resolution period: a maximum of three months, with negative administrative silence given that it concerns authorization over public domain.

Signage, Costs, and Penalty Regime

The ordinance integrates into a single text the regulation of the use of driveways and the corresponding fee for the special use of public domain, under the provisions of the Consolidated Text of the Law Regulating Local Finances. The works for lowering curbs or conditioning shall be borne entirely by the license holder.

• The reservation of space shall be marked with an official standardized plate provided by the City Council, the cost of which shall be paid by the holder.
• Unauthorized obstacles, mobile ramps, and improvised elements on the curb are prohibited, as well as the use of non-official plates.
• Licenses shall be annual and renewable, and may be revoked for duly justified reasons of public interest.
• Against the final decision, an administrative contentious appeal may be filed before the High Court of Justice of La Rioja within two months from publication.
