Torre de Capdella regulates common grazing in its mountains

The Plenary of the City Council of La Torre de Capdella has definitively approved the ordinance regulating the common grazing right on municipal-owned lands. The regulation is published in the Official Gazette of the Province of Lleida (BOP) no. 161, dated August 24, 2026, and establishes the fees per head of livestock and a sanctioning regime for infractions.
The ordinance, processed under file 575/2025, was initially approved by the Plenary on May 26, 2026, and was open for public inspection for thirty business days via an announcement in BOP no. 104 on June 3, 2026. During this period, four objections were submitted, which were resolved in the plenary session on August 11, 2026. The publication is carried out in accordance with Article 17.4 of Royal Legislative Decree 2/2004, of March 5, which approves the revised text of the Law regulating Local Treasuries.
Scope of Application and Beneficiaries
The regulation governs the grazing of bovine, ovine, goat, and equine livestock in the public utility forests 192 “Muntanya d’Aguiró” and “Sarraspina”. The right of use is granted to owners who can prove, according to custom, to have grazed for more than two consecutive years and who maintain residence and operations within the districts of Astell, Obeix, and Aguiró (for forest 192) and Envall, Beranui, Gramenet, and la Pobleta de Bellvei (for Sarraspina). The right is lost upon a change of address or residence of the holder, and companies and cooperatives only enjoy it if 100% of the partners are residents with the right.
Fees and Carrying Capacity
The grazing fee is set at:
- €15.00 per head of bovine and equine livestock.
- €1.5 per head of ovine livestock and similar.
The maximum capacity of forest 192 “Muntanya d’Aguiró” is limited to 550 head of large livestock and 1,600 head of ovine livestock, while in Sarraspina the limit is 100 units of large livestock and 200 sheep. A resting period without grazing is established for the months of February, March, and April, and the start of the season is set for June 1 in forest 192 and May 15 in Sarraspina.
Sanctioning Regime
The exercise of the sanctioning power corresponds to the City Council, which classifies infractions as minor, serious, and very serious, with fines of:
- €60 to €300 for minor infractions.
- €301 to €1,500 for serious infractions.
- €1,501 to €3,000 for very serious infractions.
In addition to the fine, an accessory sanction of loss of the right to use pastures for a period of between 1 and 5 years may be imposed in the case of serious or very serious infractions. The competent body to initiate and resolve the procedure is the mayor, and the application of the sanction does not exempt the party from repairing the damages caused or paying the defrauded fees.
The ordinance, signed by Mayor Josep Maria Dalmau Gil on August 12, 2026, will enter into force the day after its publication in the BOP. The regulation directly affects the livestock farmers of the municipality, who must report the number of animals, provide movement guides, and comply with male ratios, and it establishes a clear framework for the management and conservation of communal mountains.
