Tordesillas authorizes the FV EDF 41 photovoltaic plant with public utility status

The Territorial Service of Industry, Commerce, and Economy of Valladolid, under the Ministry of Economy and Finance, has granted the administrative construction authorization for the photovoltaic plant «FV EDF 41 (FOIN)» in the municipality of Tordesillas (Valladolid) and has specifically declared its public utility. The resolution, dated May 4, 2026, is published in the Official Gazette of Castilla y León number 172, dated September 4, 2026, under file FV-2549; ATCE-73.

The installation is promoted by Energía, Innovación y Desarrollo Fotovoltaico, S.A. (NIF A55025068), with registered offices in Barro (Pontevedra), which requested the authorization on July 28, 2022. The project, drafted by Mr. Samuel Soto Conde and endorsed by the Official College of Technical Engineers of Vigo (no. 22300530), involves a photovoltaic module on rustic land in plot 5012 of polygon 15 of Tordesillas, with evacuation to the high-voltage network of i-DE Redes Eléctricas Inteligentes, S.A.U.

Technical characteristics of the installation

The plant, utilizing photovoltaic technology with a fixed ground tracker, presents the following technical data:

• Total peak power: 1235.52 kW.
• Inverter power: 900 kW (at 40 ºC), via 4 inverters of 225 kW from 1500 Vdc to 800 Vac.
• A transformation center of 1000 kVA with a ratio of 0.8/13.2 kV.
• High-voltage underground line at 13.2 kV, 1280 meters long, up to a new sectioning center.
• Access and connection permits from i-DE Redes Eléctricas Inteligentes for 900 kW installed and 1000 kW of granted capacity.

Unfavorable reports and allegations

During the processing, the Territorial Service of Agriculture, Livestock, and Rural Development issued an unfavorable report, and the Irrigators’ Community of the Tordesillas Canal reiterated its opposition, considering that the plant is located within its irrigable zone, declared of general interest by Law 42/2006 and modernized with an investment close to 20 million euros using public and European funds. Allegations were also made by the Agrarian Technological Institute of Castilla y León and an affected owner, Ms. M.P.Z.R.

The body resolved that, pursuant to article 13.3 a) and b) of Decree-Law 2/2022, the installation is exempt from the provisions of article 13.2 of said provision, and is therefore authorizable on rustic land. The promoter expressed their willingness to make the plant compatible with the agricultural and livestock activity of the plot.

Public utility and expropriation

The declaration of public utility, supported by Article 56 of Law 24/2013 of the Electricity Sector, implies the need for the occupation of the affected assets and urgent occupation for the purposes of the Compulsory Expropriation Law, granting the company the status of beneficiary. The list of affected properties, published on December 13, 2024, includes plots from polygons 16 and 17 of Tordesillas, with permanent rights-of-way, affected areas, and temporary occupations on land belonging to the Tordesillas City Council, the Ministry of Transport and Sustainable Mobility, and various private owners.

The authorization is granted without prejudice to third parties and the mandatory municipal and environmental licenses, and requires compliance with the conditions set by the consulted bodies, including the environmental report from the Territorial Environmental Service (IMENA No. VA-G-24999-INF).

The resolution represents a decisive step for the implementation of renewables in the region, but opens a latent conflict with the irrigation of the Tordesillas Canal, an infrastructure of general interest financed with public funds. The declaration of public utility allows the developer to occupy and expropriate land in the irrigable zone, which will condition the future balance between photovoltaic generation and agricultural activity in the municipality.
