Tolmin sets 30-day deadline for municipal reply on pre-emption offers
Por FactBox Admin

Občina Tolmin has fixed a 30-day deadline for the municipality to declare itself in writing on offers falling under its statutory pre-emption right. The rule was adopted by the Občinski svet Občine Tolmin at its 34th session on 13 October 2026 and published in the Uradni list Republike Slovenije No. 1676/2026 of 16 October 2026 as the Odlok o spremembi Odloka o predkupni pravici Občine Tolmin, official reference 2026-01-2336.
What the amendment changes
The single operative article of the amendment rewrites the first sentence of paragraph 3 of Article 4 of the existing Odlok o predkupni pravici Občine Tolmin, originally published in the Uradni list Republike Slovenije No. 140/2020. The new wording reads:
- “(3) Občina se mora o sprejetju ali zavrnitvi ponudbe pisno izjaviti v 30 dneh od njenega prejema.”
The obligation is therefore twofold: the municipality must respond in writing, and it must do so within 30 days counted from receipt of the offer. The amendment does not touch the remaining provisions of the 2020 ordinance, which stays in force in all other respects.
Legal basis and procedure
The ordinance rests on Article 199 of the Zakon o urejanju prostora (ZUreP-3), published in the Uradni list Republike Slovenije No. 199/21 and subsequently amended, most recently through No. 14/26, and on Article 19 of the Statut Občine Tolmin (No. 1468/2026). The session that adopted it was the 34th of the current municipal council term.
The formal record of the act carries the following identifiers:
- Document number: 2026-01-2336
- Session act number: 007-0006/2026
- EDA reference: EDA 2026-5881455000-0019
- Signed in Tolmin on 13 October 2026 by Alen Červ, župan of Občina Tolmin
Entry into force
Under Article 2 of the amendment, the ordinance enters into force on the fifteenth day after publication in the Uradni list Republike Slovenije. With publication dated 16 October 2026, that places the start of application on 31 October 2026. Until then, the wording of Article 4 of the 2020 ordinance continues to apply as it stands.

Why it matters
For anyone selling land or buildings within the area covered by the municipal pre-emption right, the practical effect is a defined waiting period: the seller knows that the municipal position, positive or negative, must arrive in writing within 30 days of the offer being received. That converts an open-ended pause into a calculable step in the transaction, and it gives the parties a clear reference point for planning the rest of the sale. The change is narrow in scope but immediate in effect for property dealings in the municipality from the end of October.
