Tolmin rewrites public housing allocation rules to widen eligibility

The municipal council of Občina Tolmin amended the rules governing the allocation of market, official and youth housing on 15 September 2026, replacing the term “non-profit” with “public rental”, raising the property ceiling from 40% to 60% and adding an income band for six-member households. The amendment was published in the Uradni list Republike Slovenije no. 1432/2026 of 16 September 2026 (official reference EDA 2026-5881455000-0014).
The Pravilnik o spremembi Pravilnika o dodeljevanju tržnih in službenih stanovanj ter stanovanj za mlade was adopted at the 33rd session of the Občinski svet Občine Tolmin, acting under Article 29 of the Zakon o lokalni samoupravi and Article 21 of the Statut Občine Tolmin. It amends the 2021 regulation published in Uradni list RS no. 105/21 and is signed by the mayor, Alen Červ, under file number 352-0012/2021, dated Tolmin, 15 September 2026. The amendment enters into force the day after its publication in the Uradni list Republike Slovenije.
From “non-profit” to “public rental”
- Article 1: in the second indent of Article 1, “neprofitnih” is replaced by “javnih najemnih”.
- Article 2: “neprofitna” becomes “javna najemna” in the first paragraph of Article 2, and “neprofitnimi” becomes “javnimi najemnimi” in the third.
- Article 3: the same substitution is made in the first, third and sixth points of Article 4.
Property ceiling and income bands
Article 8 raises the property limit in the fourth indent of Article 16 from 40% to 60%: an applicant must not own other property exceeding 60% of the value of a dwelling suitable for them, with the rules of the law governing the exercise of rights to public funds applied by analogy. The fifth indent of Article 16 is deleted. In the sixth indent, after the 425% figure, a band for a six-member household of up to 470% is added. Income is now assessed using the rules on the types of income and how they are counted when determining eligibility for reduced kindergarten fees under the law on public funds, except the provisions on the increase for fictitious income.
Who may apply
Article 3(2) and Article 9 extend eligibility to employees of indirect budget users founded by the Republika Slovenija that operate in the area of Občina Tolmin, added to the fourth point of Article 4 and to Article 20.
Rents and allocation procedure
- Article 6 deletes the word “izhodiščno” from the second paragraph of Article 6.
- Article 7 deletes the first indent of the first paragraph of Article 14.
- Article 13 is replaced: rents for market housing are set in line with the valid Sklep o stanovanjski najemnini v Občini Tolmin.
- Article 22 is replaced: rents for official housing follow the valid Sklep o stanovanjski najemnini; the former Article 22 becomes Article 23 and Article 23 becomes Article 24.
- Article 5(4) replaces “housing issues” with “the implementation of procedures for allocating public rental and market housing and housing for young people in Občina Tolmin”.
The change widens the pool of Tolmin residents eligible for municipal housing and shifts the legal vocabulary of the scheme towards the public rental stock, while the higher property ceiling and the new six-member income band directly affect applicants previously excluded. Employees of state-founded bodies operating in the municipality gain a route into official housing.
