Tolmin fixes 30-day deadline for municipal reply on pre-emption offers

The Občinski svet Občine Tolmin has fixed a 30-day window for the municipality to declare in writing whether it accepts or rejects a pre-emption offer on land covered by its right of first refusal. The change was adopted at the council’s 34th session on 13 October 2026 and published in the Uradni list Republike Slovenije no. 1676/2026 of 16 October 2026 as the Odlok o spremembi Odloka o predkupni pravici Občine Tolmin (EDA 2026-5881455000-0019).

The instrument is a single-article amending ordinance. It rewrites the first sentence of paragraph 3 of Article 4 of the Odlok o predkupni pravici Občine Tolmin (Uradni list RS no. 140/2020), the 2020 act that governs the municipality’s statutory right of first refusal. Under the new wording, the municipality “se mora o sprejetju ali zavrnivi ponudbe pisno izjaviti v 30 dneh od njenega prejema” — it must state its position on acceptance or rejection in writing within 30 days of receiving the offer.

The amending act does not reproduce the sentence it replaces, so the earlier wording of that provision is not restated in the published text. What the gazette records is the replacement itself: the first sentence of paragraph 3 of Article 4 now carries the 30-day formulation, and the rest of the 2020 ordinance is left untouched.

The ordinance rests on two authorisations cited in its preamble:

  • Article 199 of the Zakon o urejanju prostora (ZUreP-3), published in the Uradni list RS no. 199/21 and subsequently amended by 18/23 – ZDU-1O, 78/23 – ZUNPEOVE, 95/23 – ZIUOPZP, 23/24, 109/24, 25/25 – odl. US, 75/25 and 14/26.
  • Article 19 of the Statut Občine Tolmin, published in the Uradni list RS no. 1468/2026.

The adopting body is the Občinski svet Občine Tolmin, acting at its 34th session. The act is signed by the mayor of Tolmin, Alen Červ, and carries the file number 007-0006/2026, dated in Tolmin on 13 October 2026.

Entry into force

The second and final article sets the commencement date: the ordinance enters into force on the fifteenth day after publication in the Uradni list Republike Slovenije. With publication on 16 October 2026, that places the start of application on 31 October 2026.

No transitional provisions accompany the change. The amending ordinance contains no rule on offers already pending before the municipality on the date of entry into force, and no provision preserving the previous deadline for those cases.

What changes for sellers of covered land

For an owner selling land burdened by the municipal right of first refusal, the operative point is the clock. The offer must be answered in writing, and the answer must come within 30 days of the municipality receiving it — a fixed, published limit rather than an open-ended expectation of a reply.

The practical consequences follow from that single sentence:

  • The 30-day period runs from receipt of the offer, not from its dispatch or from any later internal municipal step.
  • The municipality’s response must be in writing and must address acceptance or rejection of the offer.
  • The deadline is set in a municipal ordinance, so it binds the municipality’s own decision-making rather than leaving the timing to administrative practice.

The change is narrow in scope but direct in effect: it is one sentence in one article of a 2020 ordinance, and it governs every pre-emption offer the municipality of Tolmin receives on land within its right of first refusal. Sellers and their advisers now have a defined statutory window to plan around, and the municipality has a defined point at which its silence becomes a compliance question rather than a matter of discretion. The ordinance takes effect on 31 October 2026, two weeks after its publication in the official gazette.
