Tolmin adopts programme to fund Žabče housing zone utilities

The Občinski svet Občine Tolmin adopted the Odlok o programu opremljanja stavbnih zemljišč za območje občinskega podrobnega prostorskega načrta Stanovanjska zazidava Žabče (ŽB 05) at its 33rd session on 15 September 2026. The decree was published in Uradni list Republike Slovenije no. 1433/2026 of 16 September 2026 and enters into force the day after publication. It fixes the new utility networks to be built in the Žabče settlement, their cost, the deadlines for construction and the basis for charging the municipal contribution to future investors.

The decree rests on articles 163 and 164 of the Zakon o urejanju prostora, on the Uredba o programu opremljanja in podlagah za odmero komunalnega prispevka (Uradni list RS, št. 53/26) and on article 21 of the Statut Občine Tolmin. It implements the Odlok o občinskem podrobnem prostorskem načrtu Stanovanjska zazidava Žabče (ŽB 05), published in Uradni list RS, št. 103/2023, and the supporting Elaborat programa opremljanja no. POSZ-128-2026-1 of September 2026. The programme is available for inspection at the seat of the municipality under number POSZ-128-2026-1 and in the spatial information system.

Scope of the works

The area of intervention lies in the settlement of Žabče and covers the spatial planning unit ŽB 05. The new municipal infrastructure will connect to the existing road, water supply and sewerage networks and to existing public surfaces.

The missing infrastructure to be built consists of:

a new road network,
a new water supply network,
a new sewerage network.

A missing element of other public economic infrastructure, the electricity network, is also identified. Construction is to be carried out in a single phase.

Costs and charging basis

The total value of the new municipal infrastructure is 817,183.10 EUR, all of it financed from the budget of Občina Tolmin. The breakdown is:

new road network: 543,972.95 EUR,
new water supply network: 104,663.22 EUR,
new sewerage network: 168,546.93 EUR.

The accounting costs of the new infrastructure total 572,028.16 EUR. The three accounting areas — CESN for roads, VODN for water and KANN for sewerage — each cover 8,812 m² of building plot area and 11,972 m² of gross floor area. Unit costs per square metre of building plot and of gross floor area are set at 43.21 and 31.81 EUR for roads, 8.31 and 6.12 EUR for water, and 13.39 and 9.85 EUR for sewerage. The municipal contribution is calculated by combining the building plot area and the gross floor area of the building, weighted at 0.3 and 0.7 respectively.

Deadlines and obligations for investors

Construction must begin within 180 days of obtaining a final building permit and must be completed, and the infrastructure handed over for management, within 24 months of that permit.

Investors must also pay the corresponding share of the municipal contribution for the existing, already built infrastructure under the municipal decree in force. Where the calculated contribution for a new network exceeds that for the corresponding existing network, the share for the existing network is zero; where it is lower, the difference is charged. The municipality and the person liable may sign a connection contract under which the contribution for the new infrastructure is assessed before the works are completed, and the municipality is liable for damage if it fails to provide the connection within the agreed deadline. The cost of the private connection itself is an additional expense for the investor and does not affect the assessed contribution.

The decree was signed by the Mayor of Občina Tolmin, Alen Červ, under number 354-0074/2026, with the reference EDA 2026-5881455000-0016.

The decision gives landowners and prospective builders in Žabče a fixed price list and a defined timetable for the utilities they will depend on, and it commits the municipal budget to the full 817,183.10 EUR before any plot in the zone can be connected.
