Por FactBox Admin

The Talaveruela de la Vera City Council has initiated the opening of a sanctioning proceeding for infringement of the regulations on street vending, according to the announcement published in the Official Gazette of the Province of Cáceres number 0179, dated September 18, 2026, within Section I - Local Administration (official reference BOP-2026-4367, pages 21598-21599). The resolution, signed by the mayor-president Pedro Marín Martínez on August 10, 2026, is published after personal notification to the interested party could not be carried out.
The proceeding and the amount of the sanction
The procedure is processed under number EXP-112/2026 and affects Israel Vargas Pardo, whose identification appears anonymized in the announcement in accordance with Organic Law 3/2018 on the Protection of Personal Data. The data contained in the publication are as follows:
- File: EXP-112/2026.
- Interested party: Israel Vargas Pardo.
- Date of the complaint: 07/16/2026.
- Infringed precept: article 17-3.b of Law 8/2018, of October 23, on street trade in Extremadura.
- Sanction: 2,001 euros.
The complete file is available at the municipal offices of the City Council, where the interested party or their duly accredited representative may consult it.
Ten calendar days to appear
The notification is carried out by way of announcement under articles 44 to 46 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, as personal communication could not be effected. The interested party, or their accredited representative, has a period of ten (10) calendar days, counted from the day following the publication of the announcement in the BOP, to appear and become aware of the full content of the act.
Once this period has elapsed without the appearance taking place, the notification shall be understood to have occurred for all legal purposes from the day following the expiration of the period, and it will be from that date that the deadlines for filing appeals or paying the sanction with the corresponding discount will be computed.
Appeals against the resolution
Against the resolution, which ends the administrative route, the interested party may alternatively file:
- An optional appeal for reversal (reconsideration), regulated in articles 123 and 124 of Law 39/2015, before the same body that issued the act, within one month from the day following the receipt of the notification.
- A contentious-administrative appeal, regulated in articles 8, 45, and 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, before the competent court, within two months from the day following the receipt of the notification.
All this without prejudice to any other appeal or action that the interested party deems appropriate.
Impact for those affected
Publication in the BOP activates the calculation of deadlines and turns the announcement into the formal means of communication when personal notification fails, meaning the interested party cannot claim ignorance of the proceedings. For the street vending sector in the region of La Vera, this case serves as a reminder that non-compliance with article 17-3.b of Law 8/2018 is punished with fines that in this case reach 2,001 euros, in addition to the fixed deadlines to appeal or opt for payment with a discount.
