Taboada delegates the purchase of two plots to the deputy mayor
Por FactBox Admin

The mayor-president of the Concello de Taboada, Roi Rigueira Agromartín, has delegated to the deputy mayor, José Portela Gómez Macías, the competencies to approve the expenditure, award the contract, and recognize the obligation for the direct acquisition of plots 19 and 20 of the Taboada Business Park. The decision was adopted by mayoral resolution on October 28, 2026, signed in Taboada on October 30, 2026, and published in the Official Gazette of the Province of Lugo no. 255, on Friday November 6, 2026 (section I, pages 11-12, official reference R. 2999). The purchase is part of the package of actions funded by the Provincial Deputation of Lugo to improve the Campo da Feira and acquire two plots in the industrial estate.
What is delegated and to what extent
The resolution, processed under file 387/2026, transfers to the deputy mayor the resolving competence over three specific phases of the procedure: the approval of the expenditure, the awarding of the contract, and the recognition of the obligation. Added to this is the delegation of the signature of all documents deriving from the contract, which will be formalized at the Notaría de Monterroso, with express authority to represent the Council in that act.
The published text does not detail the amount of the purchase nor the surface area of the two plots, although it does identify their location: numbers 19 and 20 of the Taboada Business Park.
The delegation is not automatic. The resolution establishes that it will require the acceptance of the delegated body, which will be understood as tacitly granted if there is no express manifestation against it within a period of three business days from the notification. The agreement must also be communicated to the Plenary of the Corporation at the first session it holds and incorporated into the file of the actions.
The fit within the agreement with the Deputation
The purchase is justified as the execution of the Inter-administrative cooperation agreement between the Provincial Deputation of Lugo and the Concello de Taboada to finance the actions of “Improvement and urbanization of the Campo da Feira, its accesses and the surroundings of the old slaughterhouse; and acquisition of two plots in the Taboada Business Park”, in the year 2025.
The resolution recalls that the area of Culture, Education and Sport had already been delegated to the deputy mayor by decree on June 28, 2023, and that it was this same delegated body who signed the agreement with the provincial institution.
On the legal level, the decree invokes articles 106 and 107 of Law 33/2003, of November 3, on the Heritage of Public Administrations, and the second additional provision of Law 9/2017, of November 8, on Public Sector Contracts, to materialize the purchase through direct acquisition of the asset. The authorization to delegate is based on articles 21.3 and 23.4 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, and articles 44 and 47 of Royal Decree 2568/1986, of November 28, which approves the Regulation of Organization, Operation and Legal Regime of Local Entities.
Deadline and means of appeal
The resolution ends the administrative route, therefore the following may be filed against it:
- Optional appeal for reversal (recurso potestativo de reposición) before the Mayor’s Office of Taboada, within a period of one month from the day following the notification.
- Contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Lugo, within a period of six months.
- If the appeal for reversal is expressly dismissed, the period to proceed to the contentious-administrative route is reduced to two months.
The reference norm for the challenge is Law 39/2015, of October 1, on the Common Administrative Procedure, in relation to article 52 of Law 7/1985, and Law 29/1998, of July 13, regulating the contentious-administrative jurisdiction.
Why it matters to the industrial estate
The delegation is a formal procedure, but it unlocks the decisive phase of a land purchase that directly affects the municipal heritage in the Taboada Business Park and, by extension, the group of companies and owners installed in the estate. By concentrating the approval of expenditure, the award, and the notarial signature in a single body, the City Council avoids intermediate steps and gains margin to close the operation within the calendar of the agreement with the Provincial Deputation of Lugo, upon which the urbanization works of the Campo da Feira and its accesses also depend.
