Subtel transfers the FM XQB-67 concession of Santiago to Net Media Chile

The Ministry of Transport and Telecommunications modified the frequency modulated sound broadcasting concession for the distinctive signal XQB-67, for the locality of Santiago, Metropolitan Region of Santiago, whose holder changes from Garate S.A. to Sociedad Net Media Chile SpA. The decision is contained in exempt decree No. 994, dated September 11, 2026, published in the Official Gazette of the Republic of Chile No. 44,559, on Saturday, September 26, 2026, in Section II (Particular Norms), with the official reference CVE 2876924.

The modification was issued by the Undersecretariat of Telecommunications (Subtel) in the exercise of its powers and is based on Law No. 18,168, of 1982, General Telecommunications Law, and supreme decree No. 126, of 1997, which approves the Sound Broadcasting Regulations. The administrative act bears the signature of the Minister of Transport and Telecommunications, Louis de Grange Concha, and was transcribed by the Undersecretary of Telecommunications, Romina Garrido Iglesias.

The change of holder and concession data

The decree modifies the concession in the sense that its new holder is Sociedad Net Media Chile SpA, RUT No. 78,221,361-K, domiciled at General Flores Street No. 83, commune of Providencia, Metropolitan Region of Santiago. The outgoing holder is Garate S.A., RUT No. 96,822,710-6.

The regulation further establishes that the new concessionaire shall enjoy the same rights and be subject to the same obligations and responsibilities as its predecessor in the concession. It also imposes the knowledge and compliance with legal provisions, regulations, technical standards, and their modifications, insofar as they are applicable.

The background that enabled the transfer

The concession has an administrative history that the decree itself details among its recitals and considerations:

• Supreme decree No. 210, of 1988, granted the concession.
• Supreme decree No. 181, of 2010, renewed it.
• Exempt decree No. 395, of 2022, transferred it to its previous holder.
• Exempt resolution No. 1,120, of June 12, 2026, previously authorized the transfer of the concession.
• The public instrument of June 19, 2026, accounts for the act or transfer contract.
• The request for modification due to change of holder was submitted to Subtel under entry No. 89,575, dated June 25, 2026.

The file is completed with decree law No. 1,762, of 1977, which creates the Undersecretariat of Telecommunications; supreme decree No. 103, of 2008, from the same ministry; and resolution No. 36, of 2024, from the Comptroller General of the Republic, which establishes rules on exemption from the toma de razón (legal review) process.

Publication deadline and effect of non-compliance

The modification decree must be published by the new concessionaire in the Official Gazette within a period of 30 business days, counted from its notification. Such notification will be carried out from the mailboxes notificacionsubtel@subtel.gob.cl or notificaciones.electronicas@subtel.gob.cl.

The regulation warns that failure to publish within the indicated period will result in the extinction of the administrative act by operation of law, without the need for any declaration, pursuant to the final paragraph of Article 23 of Law No. 18,168. The decree closes with the standard formula: record, communicate, notify the interested party, and publish in the Official Gazette.

The change of ownership of a frequency modulation concession covering the capital implies a transfer of ownership of a media outlet with metropolitan reach, with effects on the control of the signal and on the legal and technical obligations that accompany it.
