Sojuela orders the demolition of a building in imminent ruin on Mayor Street

The Sojuela City Council has declared a state of imminent ruin for the property located at calle Mayor, number 11, after confirming the actual detachment of eaves elements over the public road, posing a current danger to the safety of people and property. By resolution of the Mayor’s Office dated September 10, 2026, the owner is required to implement security measures and proceed with the demolition of the building within 48 hours. The agreement is published in the Official Gazette of La Rioja number 177, dated September 15, 2026, via collective notification as personal notification was not possible.

The declaration is processed as Imminent Ruin Declaration File number 228/2025 and is supported by Article 199 of Law 5/2006, of May 2, on Land Use and Urban Planning of La Rioja (LOTUR). The property, with cadastral reference 7511116WM3971S0001YO, shows a generalized exhaustion of its structural elements, as confirmed by reports from the Municipal Technical Services. The estate belongs to the heirs of the deceased Ángel Rodríguez Fernández, whose title holders and heirs are in an unknown or ignored location.

Declaration of ruin and security measures

The resolution declares imminent ruin due to the existence of a danger that does not allow for the delay that would be implied by the processing of a contradictory ruin file. The owner is ordered to execute security measures and the demolition of the property under their responsibility; the works must be directed by a competent technician who expressly accepts the technical management.

Pursuant to Article 70.4 of the Urban Planning Regulations of the General Municipal Plan of Sojuela, the demolition project may be waived for the demolition of buildings in imminent ruin, with this resolution acting as the enabling title under the terms of Article 70.2 of said regulations, without prejudice to any concurrent authorizations that may be required.

Subsidiary execution and costs

If, after the granted period, the works have not commenced or the technical impossibility of their execution has not been proven, the City Council will proceed with subsidiary execution at the expense of the obligated party, in accordance with Article 199.3 of LOTUR and Articles 99, 100, and 102 of Law 39/2015, of October 1, on the Common Administrative Procedure. The resulting expenses will be demanded through administrative enforcement, with the property itself being liable for the payment of said costs.

The costs that may be charged to the property include:

• Security measures and demolition of the property.
• Technical direction of the works.
• Waste management.
• Restoration of the affected public domain.
• Corresponding fees.

Notification and appeals

The agreement is notified through its insertion in the Official Gazette of La Rioja (BOR), the Official State Gazette (BOE), and the Electronic Office of the Sojuela City Council. The complete administrative file is available to any interested party at the municipal offices, located at calle Mayor, 32, Sojuela, during public office hours.

Against the resolution, which exhausts administrative remedies, an optional Appeal for Reversal (Recurso de Reposición) may be filed before the same body within one month from the publication of the announcement in the BOE, or alternatively, a Contentious-Administrative Appeal before the Contentious-Administrative Court of Logroño within two months, in accordance with Law 29/1998, of July 13.

The demolition order within 48 hours makes this file an urgent case regarding public safety and the conservation of built heritage in the Riojan rural environment. The resolution, signed by the mayor-president Diego Fernández Orio, emphasizes the responsibility of owners in the maintenance of their properties and the municipal capacity to act subsidiarily in the face of risks to public roads.
