Slovenia sets 2025 carbon leakage aid intensity at 0.728 for exposed sectors
Por FactBox Admin

Slovenia’s ministrica za okolje in prostor, Mag. Polona Rifelj, has fixed the maximum aid intensity for 2025 at 0.728, the ceiling that governs compensation for indirect CO2 emission costs borne by sectors exposed to carbon leakage. The decision, the Sklep o maksimalni intenzivnosti pomoči za leto 2025, was published in Uradni list Republike Slovenije no. 1678/2026 of 16 October 2026 under document reference 2026-01-2338 and EVA code 2026-2580-0040. It enters into force the day after publication.
The instrument rests on the sixth paragraph of Article 9 of the Uredba o nadomestilu za kritje posrednih stroškov zaradi stroškov emisij toplogrednih plinov v korist določenih sektorjev ali delov sektorjev, ki so izpostavljeni tveganju premestitve emisije CO2, za obdobje med letoma 2025 in 2027 (Uradni list RS, no. 61/26). That regulation establishes the three-year framework for reimbursing indirect emission costs, and its Article 9(6) delegates to the minister the task of setting the annual maximum intensity.
The decision was signed in Ljubljana on 7 October 2026 under file number 007-186/2026. It runs to a single page in the Official Gazette and carries no annexes, tables or sector lists.
A single figure as the operative content
Point I of the decision contains the whole of its substantive rule: the maximum aid intensity for 2025, expressed as a share, is 0.728, equivalent to 72.8%.
Because the figure is expressly a maximum, it operates as a ceiling rather than an entitlement. The compensation actually payable to eligible installations is calculated within that limit under the 2025–2027 regulation; the decision itself awards no aid and names no beneficiaries.
Sectors exposed to relocation risk
The framework regulation directs the compensation to certain sectors or parts of sectors exposed to the risk of carbon leakage, meaning the relocation of production — and of the associated CO2 emissions — in response to climate-related cost differentials. The costs covered are the indirect ones arising from greenhouse gas emission costs.
The identification of eligible sectors and the calculation method sit in the regulation, not in this decision. The Sklep supplies only the intensity coefficient for the first year of the three-year period.
Entry into force and official record
Point II sets entry into force for the day after publication in the Official Gazette, which places it on 17 October 2026. The publication data are:
- Uradni list Republike Slovenije no. 1678/2026, dated 16 October 2026, section I, page 1.
- Document reference 2026-01-2338; EVA 2026-2580-0040; file no. 007-186/2026.
- Signed by Mag. Polona Rifelj, ministrica za okolje in prostor, Ljubljana, 7 October 2026.
- Publisher: Služba Vlade Republike Slovenije za zakonodajo; ISSN 1580-3074; volume XXXVI; electronic edition, free of charge.
For operators in the exposed sectors, the 0.728 coefficient is the number that converts verified indirect emission costs into a compensation claim for 2025, and it locks in the first of the three years covered by the 2025–2027 scheme. Since the regulation delegates the annual figure to the minister, this same instrument is the route for the remaining years of the period.
