Sena approves an ordinance against vandalism in public spaces

The Plenary of the Sena City Council initially approved, in the session of August 24, 2026, the Municipal Ordinance regulating vandalism in public spaces, a text that defines the infractions and sanctions for damage to urban furniture and public domain assets. The agreement is published in the Official Gazette of the Province of Huesca number 162, dated August 26, 2026, and is subject to public consultation for 30 days.

The regulation, signed by Mayor Esther Soler Villa, is processed under article 49 of Law 7/1985, of April 2, Regulating the Bases of Local Regime, article 56 of the Revised Text of the Local Regime, article 140 of Law 7/1999, of April 9, on Local Administration of Aragon, and article 130.2 of the Regulation of Assets, Activities, Services and Works of Local Entities of Aragon, approved by Decree 347/2002, of November 19, of the Government of Aragon.

Purpose and scope of application

The ordinance pursues two priority objectives: to prevent actions that disrupt citizen coexistence and to protect public assets under municipal ownership, as well as the facilities and elements that make up the urban and architectural heritage of the municipality. It also defines the infractions and sanctions derived from actions that, by action or omission, prevent or limit the use of public assets, spaces or services, or cause damage to public domain assets.

The scope of application extends to public buildings and their dependencies, cultural or educational centers, health centers, sports facilities and swimming pools, the cemetery, and provisional or ephemeral installations carried out for events or festivities. Protection likewise extends to the assets of other administrations and public or private entities that form part of the urban furniture, as well as facades and urban elements visible from the public road.

Responsibilities and sanctioning regime

Natural or legal persons who cause damage to the municipal public domain shall be held responsible, regardless of the repair of the damage and the restitution of what was usurped. When the perpetrator is a minor or there is a cause for non-imputability, the parents, guardians, or those with legal custody shall be responsible, and if the acts are carried out in a group without individual authorship being provable, all shall be jointly and severally liable.

Infractions are classified into three grades, with the following fines:

• Very serious: from 751 to 3,000 euros (direct vandalism with bad faith and recidivism, preventing the use of a public space, or serious deterioration of facilities).
• Serious: from 301 to 750 euros (graffiti, littering, damage to street furniture, consumption of alcohol on public roads, or unauthorized agricultural burning).
• Minor: from 60 to 300 euros (noise, depositing garbage outside of containers, bathing in fountains, or setting off firecrackers on the street).

The City Council may replace the fine with training sessions, participation in civic activities, or other unpaid community service, such as the cleaning of public spaces or the repair of the damage caused. The imposition of sanctions shall be compatible with the restoration of the situation to its original state and compensation for damages, the amount of which, appraised by technical services, must be paid within a period not exceeding thirty calendar days.

Processing and citizen participation

During the period of 30 days, counted from the day following the insertion of the announcement in the bulletin, any interested person may examine the text at the municipal offices or on the City Council’s electronic headquarters and present any allegations they deem appropriate. If no claims are presented, the agreement shall be understood as definitively approved.

The approval of this ordinance reinforces the municipality’s capacity to protect its heritage against antisocial behaviors that degrade coexistence and deteriorate the quality of life, providing the local administration with a clear instrument to sanction and repair damage to common assets.
