Security Coordination has initiated 125 sanctioning proceedings for breaches of the LOPSC regulations

The Directorate of Security Coordination of the Department of Security has notified resolutions to initiate 125 sanctioning proceedings for infringements of Organic Law 4/2015 (on the protection of citizen security). The notification was published in issue number 173 of the Official Gazette of the Basque Country, on September 10, 2026, under reference 2026/3847, and was signed by Director Asier Erkoreka Arruza in Erandio, on September 1.
After unsuccessful attempts to notify the individuals, the announcement has been published in accordance with Article 44 of Law 39/2015 (on the Common Administrative Procedure of Public Administrations). Interested parties have 15 business days, starting from the day following the publication of the announcement, to examine the file and present allegations, documents, or information in their defense.
Period and conditions for examining the files
The file is available at the Directorate of Security Coordination, located at Larrauri Mendotxe Bidea 18, Erandio. Interested parties may submit allegations within that period, as well as propose evidence they wish to use in the procedure.
If no allegations are submitted, the initiation of the procedure may be taken as a proposed resolution, considering all instructional steps prior to the sanctioning resolution as completed.
50% reduction of the fine
If the fine is paid within 15 days following the notification, the amount will be reduced by 50%, according to Article 54 of Organic Law 4/2015. The payment slip is available at the directorate in Erandio.
Types of infringements and volume of files
The files included in the annex allege violations of several articles of Organic Law 4/2015 by the interested parties, including:
- Article 36.10 (minor infringements), the most frequent.
- Articles 36.06 and 36.16, minor and serious infringements.
- Articles 37.04, 37.05, 37.07, and 37.15, serious infringements.
- Articles 36.03 and 37.01, in specific cases.
The infringements occurred between September 2025 and May 2026, and the resolutions were issued between April and August 2026. Each file has a reference number starting with 405X, and interested parties are identified by DNI, NIE, passport, or foreign identification.
The notifications were published in the Official State Gazette and will have effect from the following day. This high-volume collective notification reflects the usual flow of sanctioning procedures in the field of security and affects many citizens, with a short period to take advantage of the option to reduce the fine.
