Santa Coloma updates the sanctions of the municipal cleaning ordinance

The Santa Coloma de Gramenet City Council has definitively approved the modification of the General Cleaning Ordinance, which updates Annex IV regarding the table of infractions and sanctions corresponding to titles II, III, IV, V, and VI of the regulation. The agreement, adopted by the Municipal Plenary in the session of April 27, 2026, is published in the Official Gazette of the Province of Barcelona on August 24, 2026 (reference CVE 202610135162, pp. 1-69).

During the public exhibition period, no allegations were presented, and the agreement and the full text were forwarded to the State Administration (Government Delegation in Catalonia – Government Sub-delegation in Barcelona) and to the Generalitat de Catalunya (Directorate General of Local Administration of the Department of the Presidency), in accordance with article 65.3 of Decree 179/1995 and article 70.2 in relation to 65.2 of Law 7/1985. Once the deadline expired, there is no record of any of these institutions issuing a report. The ordinance will enter into force the day after the publication of the full text in the BOP.

A renewed table of sanctions

The modification updates the sanctioning regime for street cleaning, waste collection, and the management of soil and rubble. Fines are graded up to a maximum of 900 euros, taking into account good or bad faith, economic capacity, recidivism, social significance, and illicit benefit. Among the typified infractions, the following stand out:

• Throwing or abandoning waste on public roads: 400 € (recidivism 800 €).
• Abandoning bulky waste in large quantities: 470 € (1,420 €).
• Throwing lit cigarettes or cigars: 90 € (240 €).
• Relieving oneself on public roads: 180 € (450 €).
• Failing to comply with the obligation to maintain plots in conditions of safety, health, and decorum: 470 € (1,420 €).
• Graffitiing without municipal authorization: 140 € (400 €).
• Dumping flammable, explosive, or harmful waste in construction containers: 950 € (1,420 €).

Cleaning and maintenance obligations

The text consolidates the obligations of citizens and owners of properties and plots, such as keeping the spaces in front of facades clean, not dirtying public roads during works and loading, and respecting collection schedules. The City Council may subsidiarily execute cleaning works and charge the cost to those responsible, without prejudice to the corresponding sanction. The regulation repeals the cleaning ordinance approved on April 26, 1993, and its modification of March 31, 2003.

Procedure and prescription

Infractions may be sanctioned without a prior proceeding, but the right to a hearing for the interested party is guaranteed: from the notification of the complaint, the accused has ten days to present allegations. Infractions prescribe six months from the time the Administration becomes aware of them, unless a higher regulation establishes a longer period. The edict, signed by the acting mayor Antonio Atienza Martínez (D.A. 5625 of 17/06/2026) on August 20, 2026, is final in the administrative route and may be appealed in contentious-administrative proceedings before the Contentious-Administrative Chamber of the High Court of Justice of Catalonia within a period of two months.

The new regulation reinforces the municipal sanctioning capacity regarding cleaning and waste, with a more detailed framework and updated amounts that directly affect residents, businesses, construction works, and street activities. For readers, it represents a clearer framework of rights and duties in the maintenance of public roads and city plots.
