Sant Salvador de Guardiola entrusts the Generalitat with disciplinary files for security guards

The City Council of Sant Salvador de Guardiola has definitively approved the collaboration agreement with the Department of the Interior and Public Security of the Government of Catalonia for the processing of reserved information proceedings or disciplinary proceedings within the scope of its municipal warden corps. The agreement, signed on 23 July 2026, is published in the Official Gazette of the Province of Barcelona of 30 July 2026 (CVE 202610125817), with the signature of the Mayor, Anna M. Llobet Solé.
The City Council plenary initially approved the agreement at its session of 11 March 2026 and submitted it to public information for thirty days by means of a notice published in the BOPB of 8 June 2026. As no claims or allegations were received, the initial approval agreement became final, and the full text is now published.
The council had requested the appointment of an instructor to process a file arising from the conduct and actions of a municipal warden that could be subject to disciplinary action. The legal basis is Article 17.5 of Decree 179/2015, of 4 August, approving the Regulation of the disciplinary regime procedure applicable to local police forces of Catalonia, and allows the mayor to request the collaboration of the department competent in the regulation and coordination of local police forces.
Signatories and legal framework
- For the Government of Catalonia, Tomás Carrión i Bernal, Secretary General of the Department of the Interior and Public Security, acting under Resolution INT/81/2011, of 18 January, on delegation of powers (DOGC No. 5802, of 24 January 2011).
- For the City Council, the Mayor Anna Maria Llobet Solé, authorized by the plenary agreement of 17 June 2023.
- The agreement is structured as a management assignment between administrations, in accordance with Articles 10 and 116 of Law 26/2010, of 3 August, and Article 11 of Law 40/2015, of 1 October.
What the parties undertake to do
- The Department of the Interior and Public Security, through the Deputy Directorate General for Support to the Local Security System, will propose an official from a corps or category of equal or higher rank to process the file and, where applicable, a secretary.
- The City Council will provide the necessary material and technical means, pay the instructor’s expenses (subsistence allowances and mileage), appoint a municipal secretary when the complexity of the procedure so requires, and ensure the confidentiality and the rights of the person subject to the proceedings and of the witnesses.
- The term runs from signing until the completion of the proceedings, with a maximum of four years, extendable by up to four additional years by unanimous agreement of the parties.
Monitoring, expenses and conflicts
A monitoring, oversight and control committee is created, made up of the municipal secretary or a delegated representative, a municipal Human Resources technician, and two technicians designated by the Deputy Directorate General for Support to the Security System at the Local Level. The committee shall meet at the request of any of the parties whenever considered necessary, and one of the Department’s technicians shall draft the minutes.
Signing the agreement does not entail any expense or financial commitment for either party, except for the service-related compensation provided for in the second clause. Litigious matters concerning the interpretation, modification or termination of the agreement that are not resolved by mutual agreement shall be referred to the contentious-administrative jurisdiction.
With this agreement, Sant Salvador de Guardiola activates an internal control mechanism for the body of guards in which the processing of disciplinary files is transferred to the Generalitat, a model provided for by the disciplinary regulations of the Catalan local police forces. For readers, the relevance is twofold: conduct subject to disciplinary reproach will be processed by means that are specialised and external to the municipality, and transparency and guarantees in the control of municipal officers are strengthened.
