Sant Cugat Sesgarrigues definitively approves the ordinance prohibiting alcohol on the street

The Plenary of the Sant Cugat Sesgarrigues City Council, in the session of June 25, 2026, initially approved the regulatory ordinance on the consumption of alcohol on public roads, and the agreement has become final as no allegations or suggestions were presented during the public information period. The announcement of final approval is published in the Official Gazette of the Province of Barcelona on September 22, 2026, with the official reference CVE 202610141021 and the validation code 1MT37-8XOQ0-3GZ52. The text is signed by the mayor, Raül Casado Ruiz, on September 14, 2026.

Processing and public exhibition

The regulation has been processed in accordance with article 178.2 of Legislative Decree 2/2003, of April 28, which approves the revised text of the Municipal and Local Regime Law of Catalonia, and article 66.1 of Decree 179/1995, of June 13, of the Regulation of works, activities, and services of local entities. The public information period was opened with the edict published in the following media:

• Official Gazette of the Generalitat de Catalunya no. 9701, of July 6, 2026.
• Official Gazette of the Province of Barcelona, of July 6, 2026.
• Notice board and e-board of the Corporation, from July 7 to August 20, 2026, both inclusive.

The municipal file is 2026 646. Against the agreement, which is final in the administrative route, a contentious-administrative appeal may be filed before the High Court of Justice of Catalonia within a period of two months, or, optionally, a motion for reconsideration before the City Council within a period of one month.

Prohibitions and exceptions

The ordinance prohibits the consumption of alcoholic beverages on public roads, especially when it alters or disturbs citizen coexistence, and expressly forbids the organization and participation in any “botellot” event, understood as the street consumption of drinks brought by the consumers themselves without authorization. The following are excluded from the prohibition:

• Spaces expressly reserved for this purpose, such as bar and restaurant terraces.
• Events approved through municipal authorizations, such as popular festivals and concerts.

Disturbance is considered to have occurred when, according to the assessment of the municipal authority or police forces, the consumption may be massive or invite crowding, when it is a party serving as an alternative to another with authorization, when it deteriorates the tranquility or health of the environment, or when the location is characterized by the influx of children and adolescents.

Temporary suspensions and sanctioning regime

Article 4 temporarily suspends the objectives of the regulation for festive, cultural, and social activities of a traditional nature rooted in the municipality: the Festa Major, the Festa del Most, the Sant Joan’s Eve, the Carnival, and neighborhood festivals. The suspension is only valid at the specific location identified in the official program of each event, not in the rest of the municipality; for events without an official program, a prior report from the relevant municipal service and express authorization from the City Council will be required.

Infractions are classified as very serious, serious, and minor, and the sanctions are:

• Very serious infractions: fine from 1,001 to 3,000 euros.
• Serious infractions: fine from 501 to 1,000 euros.
• Minor infractions: fine from 200 to 500 euros.

A 50% discount on the amount is provided if the fine is paid within 15 days following the notification. The competence to initiate proceedings and impose sanctions corresponds to the mayor, and law enforcement agents may provisionally seize drinks and containers, which will be destroyed.

Entry into force

In accordance with article 70.2 of Law 7/1985, of April 2, the ordinance enters into force once definitively approved by the corporation and 15 business days after its full publication in the Official Gazette of the Province of Barcelona.

The regulation directly affects residents, the hospitality industry, and entities that organize festive activities in the municipality, which must adjust alcohol consumption in the street to the new sanctioning framework and request express authorization for events that do not appear in an official program.
