The Territorial Department of Pontevedra, under the Ministry of Health, has notified the agreement to initiate sanctioning proceedings 20260200VS-PO against the holder of NIF 36093490G for an alleged health-related infringement. The agreement was issued on September 11, 2026, by the territorial director, María Dolores Bazán Arcay, and is published this Thursday in the Official Gazette of Galicia (DOG no. 201, of October 22, 2026, p. 53383), after personal notification could not be carried out. The proposed fine amounts to 300 euros.
The announcement, signed on October 8, 2026, explains that the attempt at notification according to articles 40 and following of Law 39/2015, of October 1, on the common administrative procedure of public administrations, was unsuccessful, therefore resorting to notification by means of an announcement according to article 44 of the same regulation. The effectiveness of the notification is subject to its publication in the single board of edicts (TEU) of the Official State Gazette (BOE).
The same edition of the gazette includes a similar announcement, that of proceeding 20260199VS-PO (p. 53385), issued on September 9, 2026, against the holder of NIF X05330664T, with the last known address in Vigo and an identical proposed fine of 300 euros. Both respond to the same type of infringement and the same edictal notification pattern.
A minor infringement for lack of respect
The annex of the announcement specifies the imputed fact: an alleged infringement of the provisions of article 15 of Law 8/2008, of July 10, on the health of Galicia, as amended by Law 3/2026, of March 30, which establishes prevention and comprehensive protection measures against violence in the Health System of Galicia.
The conduct is classified as a minor administrative infringement in article 41.ter, letter a), of the same regulation, which includes:
- Lack of respect or insults toward health authorities and their agents.
- The same conduct against the professionals referred to in the second paragraph of point 23 of article 3.
- The breach of the relationship of trust during the exercise of their functions or on the occasion thereof, when it does not constitute a serious or very serious infringement.
The provision specifies that the classification applies “without prejudice to the consequences or effects arising from a criminal and deontological point of view.”
Fifteen business days to appeal
The affected person has a period of 15 business days, counted from the day following the publication of the announcement, to present allegations before the territorial department, under article 76 of Law 39/2015. The written submission may be accompanied by a consultation of the file, which is deposited in the department’s offices in Pontevedra.
The announcement details these points:
- Place of consultation: Administrative Building of the Xunta de Galicia, avenida María Victoria Moreno, no. 43, 1st floor, Pontevedra, with the right to obtain a copy of the file according to article 53.1.a).
- Last address appearing in the annex: lugar O Mosteiro, 46, 36842, Pazos de Borbén (Pontevedra).
- If no allegations are presented, the initiation agreement may be considered a proposed resolution when it contains a precise statement on the imputed responsibility, in accordance with article 64.2.f).
- Before the resolution of the procedure, the interested person is entitled to the reductions established in article 85 of Law 39/2015.
Opening without a final resolution
The publication of announcements of this type is the legally provided route when personal notification fails, so that the procedure is not halted. The text makes it clear that the initiation agreement is not a final sanction: it opens the investigation phase and provides the first opportunity for defense for the affected person.
The resolution that ends file 20260200VS-PO will determine whether the 300 euro fine is confirmed or modified, once the allegations have been assessed or the deadline has passed without them.
