Health Department declares the expiration of the Personnel Management position for the Zaragoza II Sector

The Zaragoza II Sector Management has declared the expiration of the provision procedure, via the free appointment system, for a Head of Personnel Service position within that health sector. The decision is formalized in the Resolution of August 31, 2026, and published in the Official Gazette of Aragon number 181, of September 17, 2026, with the reference BOA20260917006. The management position of the Aragonese Health Service thus remains vacant.

The procedure had been opened with the Resolution of December 19, 2025, from the Zaragoza II Sector Management, published in the Official Gazette of Aragon number 4, of January 8, 2026. The application deadline ended on January 30, 2026, and the Selection Committee was appointed by Management resolution on March 3, 2026. Since then, the final resolution required by the regulations was not published.

The Zaragoza II Sector Management acts under the authority of Decree 37/2011, of March 8, of the Government of Aragon, regarding the selection of statutory personnel and the provision of positions in the centers of the Aragonese Health Service, and Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

A call that expires without resolution

Article 74 of Decree 37/2011 requires the Sector Management to which the health center belongs to issue a resolution and publish it within a maximum period of six months from the day following the publication of the call in the Official Gazette of Aragon. Once this period has elapsed without a published resolution, applicants who participated may consider their claims dismissed due to administrative silence.

In this case, the maximum six-month period passed without the final resolution being published, which has led the Zaragoza II Health Sector Management to conclude the procedure by declaring its expiration.

Chronology of the procedure

• December 19, 2025: resolution of the Zaragoza II Sector Management calling for the Head of Personnel Service position.
• January 8, 2026: publication of the call in the Official Gazette of Aragon number 4.
• January 30, 2026: end of the application submission period.
• March 3, 2026: appointment of the Selection Committee by Management resolution.
• August 31, 2026: resolution declaring the expiration of the procedure.
• September 17, 2026: publication of the expiration in the Official Gazette of Aragon number 181.

The regulatory basis for the expiration

The resolution invokes Article 21 of Law 39/2015, which obliges the Administration to issue an express resolution and notify it in all procedures, and its Article 84, which places the declaration of expiration among the forms of termination of the procedure. It also relies on Law 55/2003, of December 16, of the Framework Statute of statutory personnel of health services, modified by Royal Decree-Law 12/2022, of July 5.

The text further recalls that the Selection Committee may declare the provision void, by means of a reasoned resolution, when no suitable candidates meet the requirements of the call, a different route from the expiration finally applied.

Administrative appeal against the resolution

Against the resolution, which does not end the administrative route, an administrative appeal (recurso de alzada) may be filed before the Management Directorate of the Aragonese Health Service within one month from the day following its publication in the Official Gazette of Aragon. The resolution is signed in Zaragoza on August 31, 2026, by the Manager of the Zaragoza II Sector, Patricia Palazón Saura.

The procedure is supported by Article 48.2 of the Recast Text of the Law of the Aragonese Health Service, approved by Legislative Decree 2/2004, of December 30, of the Government of Aragon, and by Articles 121 and 122 of Law 39/2015.

The expiration leaves a managerial head of service position vacant in the staff of the Zaragoza II Sector, without the call having designated a holder or declared it void. The episode illustrates the practical effect of administrative silence in the provision of singularized positions of the Salud: the process is closed due to the expiration of the deadline and the position remains pending a new call.
