Fine of 29,508 euros for Malvarruiz Soluciones Termosolares for occupational risks

The General Directorate of Labor, Cooperativism, and Occupational Safety of the Generalitat Valenciana has ordered the publication of the final sanction of €29,508.60 imposed on the company Malvarruiz Soluciones Termosolares, SL for a very serious infringement regarding occupational risk prevention. The resolution, signed on July 16, 2026, by the general director Maria Lurueña Ruiz, is published in the Official Gazette of the Generalitat Valenciana (DOGV) number 10440, dated August 31, 2026, with reference DOGV-C-2026-26665.

The sanctioning procedure, with case number 032023SAT000440, was initiated via infringement report number 32023000080637, issued by the Labor and Social Security Inspectorate of Alicante on May 2, 2023. The sanction became final on June 20, 2026.

Regulatory framework of the sanction

The publication is carried out in compliance with Article 40.2 of Royal Legislative Decree 5/2000, of August 4, which approves the consolidated text of the Law on infringements and sanctions in the social order (TRLISOS), and Royal Decree 597/2007, of May 4, regarding the publication of sanctions for very serious infringements in occupational risk prevention. Competence is exercised in accordance with Article 8 of Decree 57/2008, of April 25, of the Consell.

The infringement, classified as very serious under Article 13.10 of the TRLISOS, refers to the violation of obligations to protect the health and safety of workers, with non-compliance with Law 31/1995, of November 8, on occupational risk prevention, the Workers’ Statute, and the regulations for prevention services and personal protective equipment.

Deadlines and effects of the publication

The final sanctioning resolution may be challenged before the judicial bodies of the social jurisdictional order within two months, counting from the day following its notification, in accordance with Law 36/2011, of October 10, regulating the Social Jurisdiction. Furthermore, according to Article 4.2 of Royal Decree 597/2007, the data of the sanctioning resolution will be deleted five years from the day following its publication.

The mandatory publication of very serious sanctions in occupational risk prevention reinforces transparency and the deterrent effect of the sanctioning regime, while informing workers and sector operators about the non-compliance established by the Labor Inspection.
