San Román de los Montes approves the parks and gardens ordinance

The City Council of San Román de los Montes has finalized the municipal Ordinance regulating the use of public facilities, parks, and gardens, after no claims were filed during the public exhibition period. The full text is published in the Official Gazette of the Province of Toledo, number 180, dated September 21, 2026, with verification code 2026.00004104 and reference No. I.- 4104. The regulation comes into force on the same day of its publication in the provincial gazette.

The Ordinance was initially approved by the Plenary and subsequently submitted for public information and hearing of interested parties for thirty days, in accordance with the provisions of article 70.2 of Law 7/1985, of April 2, on the Bases of Local Government. As no claims or suggestions were registered, it was definitively approved without the need for an express agreement from the plenary body. The text was published simultaneously on the municipal notice board and on the City Council’s web portal, hosted at sanromandelosmontes.sedelectronica.es, to gather additional contributions from citizens and entities. The agreement was signed in San Román de los Montes on September 9, 2026, by the mayor, Luisa Consuelo Nieto Wooll.

Scope of Application

The regulation governs the utilization, use, and enjoyment of municipal facilities, parks, gardens, green areas, urban furniture, and trees within the municipal district. Article 1 expressly lists the affected spaces:

• Swimming Pool Park (Piscina Street)
• Erilla Park (Serranillos Avenue)
• Ermita Park
• Reguerito Park
• Cordel Park
• Reguerones municipal park
• “Los Trilladores” Sports Center
• “El Barrenal” football field
• El Pozo Blanco

Parks with fencing or usage control shall remain open according to the schedules set by the Mayor’s Office, which may be modified depending on the time of year; access outside of these hours shall constitute an infringement. Gardens without fencing shall remain open to the public throughout the day and night.

Prohibitions and Usage Regime

The text prohibits activities that cause accidents, damage plant species or furniture—including paintings and graffiti—, obstruct passage, or disturb the tranquility of green areas. The practice of “botellón” (street drinking) is specifically regulated, defined as the concentration of a significant number of people consuming beverages, preferably alcoholic, that cause nuisance to neighbors and users. Law enforcement officers may cautiously seize beverages and containers, which will be destroyed for reasons of hygiene and public health.

Camping outside of designated areas, washing vehicles or clothes, taking water from irrigation outlets, bathing in fountains and ponds, carrying out repair work, or posting signs without authorization is also prohibited. Regarding animals, dogs are banned from signaled landscaped areas for children’s use, and the existence of Canine Recreation Areas in the municipality is reminded. Only bicycles, skates, and scooters may circulate in the areas signaled for that purpose, while vehicles for people with reduced mobility may do so freely throughout all parks.

Infractions and sanctions

Infractions are classified as minor, serious, and very serious, in accordance with the amounts in Article 141 of Law 57/2003, of December 16, on Measures for the Modernization of Local Government:

• Minor infractions: fine of up to 750 euros.
• Serious infractions: fine from 750.01 to 1,500 euros.
• Very serious infractions: fine from 1,500.01 to 3,000 euros.

The competence to impose fines corresponds to the Mayor’s Office, through the established sanctioning procedure. Anyone who has committed an infraction on the same matters in the previous twelve months is considered a repeat offender. The practice of “botellón” (street drinking) is classified as serious when it seriously disrupts coexistence or deteriorates the health of the public space, and as very serious when the work of authority agents is obstructed.

Validity and appeals

The Ordinance shall remain in force unless it is expressly modified or repealed, and the Mayor’s Office may develop it through proclamations of general application. An administrative appeal may be filed against the agreement before the Contentious-Administrative Chamber of the High Court of Justice of Castilla-La Mancha, based in Albacete, within two months from the day following the publication of the announcement, in accordance with Article 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.

The entry into force of the regulation provides the municipality with its own legal instrument to protect its green areas and regulate the use of sports centers, children’s parks, and public spaces. Residents and users of these facilities now have clear rules regarding schedules, permitted uses, and responsibilities, as well as a sanctioning regime that can reach 3,000 euros in the most serious cases.
