San Martín del Rey Aurelio approves the new vehicle entry fee

The City Council of San Martín del Rey Aurelio has definitively approved the modification of fiscal ordinance number 16, which regulates the fee for vehicle entry via sidewalks and the reservation of public roads for exclusive parking, loading, or unloading of goods. The announcement is published in the Official Gazette of the Principality of Asturias (BOPA) number 169, dated September 1, 2026, under code 2026-07065.

The Municipal Plenary, in an ordinary session held on May 28, 2026, agreed to the provisional approval of the modification. Following the public exhibition period of the file without any claims being filed, the agreement is understood to be definitively adopted, in accordance with articles 17.3 and 17.4 of the consolidated text of the Law Regulating Local Treasuries (Royal Legislative Decree 2/2004, of March 5), without the need for a new plenary agreement.

What the new ordinance regulates

The regulation establishes the taxable event of the fee on the private use or special exploitation of the municipal public domain derived from:

• The entry and exit of vehicles via sidewalks or roadways.
• The reservation of spaces on public roads for exclusive parking.
• The reservation of spaces for the loading and unloading of goods.
• The reservation of spaces for vehicle stops.

Taxable events occur both on roads with vehicular traffic and in pedestrian areas, even when the exploitation is carried out without the mandatory administrative authorization. Taxpayers are natural and legal persons, dormant estates, communities of assets, and other entities without legal personality; the owners of the properties and premises to which the vehicle entrances provide access act as substitutes for the taxpayer.

Rates by road category

The fees are calculated based on a unit value linked to the occupation of the public domain, considering linear meters, intensity of use, location, and duration of use. The municipality’s roads are classified into four fiscal categories listed in Annex I of the ordinance, and when the exploitation affects several roads, the rate of the higher category is applied.

• Permanent driveways in private nurseries: between 107 and 644 euros per 5 linear meters per year depending on the category and number of places.
• Access points in warehouses, shops, and industries: from 189 to 885.50 euros annually depending on the intensity of use (low, medium, high, or very high).
• Driveways with limited hours: daytime at 60%, nighttime at 75%, and working days at 50% of the permanent fee.
• Space reservations: between 27.45 and 70.15 euros per linear meter per year, with 15% discounts for bus lines and a fixed rate of 47.35 euros per vehicle for taxi stops.

The signage for the usage permits is carried out by municipal services and its cost is passed on to the holder as a cost reimbursement, not as a tax benefit.

Authorization and Control Regime

Authorizations are granted on a discretionary and reasoned basis, taking into account traffic management, road safety, and accessibility. The City Council may suspend them, revoke them, or adopt material enforcement measures—such as the removal of signage or the installation of bollards—in the event of improper use or usage without a qualifying title. Unauthorized usage requires the restoration of the public domain within fifteen days, without prejudice to the settlement of the accrued fees.

The ordinance repeals the previous fiscal ordinance number 16 and establishes that the previous rates will continue to apply until December 31, 2026. The regulation enters into force on the day of its publication in the BOPA, although its tariff regime will be applicable as of January 1, 2027.

The new regulation directly affects residents, businesses, and industries of the council, who must adjust their driveways and space reservations to the new rates and a stricter control regime of the public domain. The text, signed by the Acting Mayor on August 19, 2026, also introduces a tax classification of all the streets in the municipality, which will determine the amount of the fee in each case.
