San Mamés delegates a civil marriage to its deputy mayor
Por FactBox Admin

The mayor-president of the City Council of San Mamés de Burgos, Álvaro Castrillejo Peña, has delegated to the deputy mayor, Eloy Herrera Bárcena, the celebration of the civil marriage scheduled for September 28, 2026, as he is unable to personally exercise this competence due to work reasons. The decision was formalized by a Mayoral decree signed on September 23, 2026, and is published in the Official Gazette of the Province of Burgos no. 185, of September 29, 2026, in section III. Local Administration, with the official reference BOPBUR-2026-04114.
The text is reproduced literally in the gazette, within the section on the delegation of powers of the City Council of San Mamés de Burgos, and bears the signature of the mayor and the secretary-auditor, Alejandro Ayllón Requera, who certifies the resolution. The publication responds to the obligation to publicize the delegation of municipal powers for general knowledge.
The reason for the delegation
The decree is based on an explicit consideration: on September 28, 2026, the mayor-president will be unable to exercise, “for work reasons,” the power attributed to him by Article 51 of the Civil Code for the celebration of civil marriages in his capacity as mayor of the municipality.
Given this circumstance, the mayor resolves to transfer the function to the deputy mayor, Eloy Herrera Bárcena, so that he may officiate and formalize the ceremony on behalf of the City Council. The delegation is limited to that specific act and the indicated date.
The contracting parties and the ceremony
The civil wedding will be held at the City Council of San Mamés de Burgos on September 28, 2026, one day before the publication of the decree in the provincial gazette. The contracting parties are:
- Ana María Pérez Andrés
- Marc Guillamí Márquez
The decree expressly identifies both and sets the place and date of the union, such that the authorization of the deputy mayor is limited to that ceremony.
Legal basis and subsequent procedures
The resolution is based on Article 21.3 of Law 7/1985, of April 2, regulating the Bases of the Local Regime; Article 43.3 of Royal Decree 2568/1986, of November 28, which approves the Regulation of Organization, Operation, and Legal Regime of Local Entities; and Article 51.2.1.º of the Royal Decree of July 24, 1889, which approves the Civil Code.
The decree is structured into four sections:
- First: delegate to the deputy mayor the delegable powers of the mayor in accordance with Article 51.2.1.º of the Civil Code, to officiate and formalize the civil marriage.
- Second: notify the interested party of the resolution, in accordance with the applicable regulations.
- Third: make the agreement public for general knowledge, in compliance with Article 44.2 of Royal Decree 2568/1986.
- Fourth: report to the Plenary of the corporation at the next session to be held.
The document is issued and signed by the mayor on September 23, 2026, with the intervention of the secretary-auditor.
Neighborhood Relevance
The publication allows the residents of San Mamés de Burgos to know who effectively exercises the competence to perform the marriage and under what regulatory support, a relevant point in small municipalities where the mayor concentrates civil and administrative functions. The decree provides a record of the temporary distribution of powers and the commitment to inform the Plenary, which reinforces the transparency of the procedure.
