San Ildefonso approves the municipal remote work regulations

The City Council of the Royal Site of San Ildefonso has definitively approved the Teleworking Regulatory Regulations for its municipal staff, after concluding the public information process without any claims or suggestions being submitted. The decision, adopted by the Plenary via agreement on May 28, 2026, is published in the Official Gazette of the Province of Segovia number 105, dated September 2, 2026, with reference RC-11638.

The text was initially approved by the Plenary on May 28, 2026, and submitted for public information and hearing of interested parties through an announcement published in the BOP of Segovia number 68, dated June 8, 2026, for a period of 30 business days. As no allegations were received, the provisional agreement is understood to be definitively approved, and its full text is published in the gazette.

A voluntary and reversible modality

The regulations conceive teleworking as a complementary modality to in-person service, based on the use of information and communication technologies, and of a voluntary and reversible nature. Adherence does not consolidate any permanent right and may be requested in two modalities:

  • Regular teleworking, through the signing of a commitment document that establishes the non-in-person weekly days.
  • Occasional teleworking, for a duly justified cause, which must be requested, as far as possible, 48 business hours in advance.

The regulation applies to all active personnel, both civil servants and contractual staff, who occupy positions compatible with this modality and meet the requirements of Article 5, including having held the position for at least three months and possessing the necessary computer skills.

Working day, time control, and monitoring

The working day under the teleworking regime shall not exceed 2 days per week, with the same schedule and flexibility as in-person service, and the authorization will have a renewable six-month validity. Compliance with the working day will be accredited through the City Council’s time control system via geolocated clock-in, and during the working day, the worker must remain reachable and available.

The monitoring of regular teleworking will be carried out through random internal audits and the evaluation of objective fulfillment. The authorization may be temporarily suspended due to service needs, terminated for various reasons, and revoked for failure to meet objectives or for disciplinary reasons, following a hearing with the teleworking person.

Rights, means, and guarantees

Staff working remotely retain the same individual and collective rights and duties as those working on-site, with no variation in their ordinary remuneration or working hours. Privacy, the inviolability of the home, data protection, and digital disconnection are expressly guaranteed, such that outside of working hours, there is no obligation to respond to communications from the City Council.

The City Council will provide, subject to availability, the indispensable technological means under a loan agreement, and no financial compensation for expenses derived from remote work will be recognized unless expressly provided for. Furthermore, a Remote Work Monitoring Commission will be established, composed of the Councilor for Personnel, the HR Technician, the representative for civil servant personnel, and a member of the committee, to ensure the application of the regulation.

The regulation is based on the state regulatory framework, including, among others, Article 47 bis of the consolidated text of the Basic Statute of the Public Employee (Royal Legislative Decree 5/2015), Law 10/2021 on remote work, and the European Framework Agreement on Telework of July 16, 2002.
