The City Council of San Cibrao das Viñas has finalized the modification of the Regulatory Ordinance for grants to promote natality, which sets 250 euros per birth or adoption and opens the door to reviewing denied files in 2026. The agreement is published in the Official Gazette of the Province of Ourense on September 24, 2026 (reference R. 2.236), after no claims were presented during the public exhibition period. The regulation enters into force on the same day as its publication, in accordance with article 70.2 of Law 7/1985, of April 2, on the bases of the local regime.

Plenary approval and procedure

The text was automatically finalized as no claims or suggestions were registered during the public information period. The initial agreement was approved in the extraordinary session of the Plenary on July 22, 2026, with the favorable vote of the eleven councilors of the Municipal Group of the People’s Party and two abstentions from the councilors of the Socialist Municipal Group, with thirteen councilors present out of a total of thirteen members of the Corporation. The announcement is signed by the mayor, Marta Nóvoa Iglesias.

The agreement authorized the Mayor’s Office to sign all types of documents related to the matter and submitted the modification to public information for thirty days, with publication in the BOP and on the City Council’s notice board, in addition to the municipal electronic headquarters portal. The legal basis of the ordinance is articles 2 and 25.1 of Law 7/1985, of April 2.

Amount, beneficiaries and requirements

  • Grant of 250 euros per boy or girl born or adopted.
  • In multiple births, an additional 100% is recognized for each child, with the same percentage for adoptions of more than one person.
  • Beneficiary: one of the parents or adopters with residence fixed in the municipality and uninterrupted registration (empadronamiento) for 12 months prior to the event motivating the grant.
  • In cases of nullity, separation or divorce, the parent who has custody collects it; with joint custody, both receive 50%.
  • In adoptions, the minor must be under 6 years old.
  • Application period: six months from birth or adoption, at the General Registry.
  • Amendment of incomplete documentation: 10 days, with withdrawal if not corrected.
  • Resolution: corresponds to the mayor and ends the administrative route.
  • Compatibility: the grants are compatible with those from the State or the Autonomous Community.

Effective payment requires that both the beneficiary and the minor remain registered in the municipality for the 12 months following the resolution, a circumstance that the City Council verifies ex officio and which may lead to the reimbursement of the subsidy. The global amount depends on the annual budget item; if the number of applications exceeds the enabled credit, the council may proportionally reduce the grants or expand the budget item.

Review of denied files in 2026

The sole transitional provision allows for a new assessment of birth grant applications submitted during 2026 prior to the entry into force of the modification and denied exclusively for failing to meet any of the requirements that are modified or eliminated. Interested parties may request a review of their file within one month from the entry into force, without prejudice to the City Council agreeing ex officio to the review of those files in which compliance with the new regulation is recorded. The granting is subject to compliance with the remaining requirements of the ordinance and the existence of adequate and sufficient credit.

Appeal and judicial route

A contentious-administrative appeal may be filed against the agreement before the Contentious-Administrative Chamber of the High Court of Justice of Galicia, based in A Coruña, within a period of two months counted from the day following the publication of the announcement, in accordance with article 46 of Law 29/1998, of July 13, of the contentious-administrative jurisdiction.

The modification directly affects families registered in San Cibrao das Viñas who have a child or formalize an adoption, and in particular those whose application was denied in 2026 due to requirements now suppressed or reformed, who have one month to request the reopening of their file.
