Salou terminates the funeral rights of new niche holders due to non-payment

The Salou City Council has resolved the extinction of the funeral rights of nine niche holders at the municipal cemetery due to non-payment of the corresponding taxes for five consecutive years. The decision is published in the Official Gazette of the Province of Tarragona on September 24, 2026, with the official reference CVE 2026-08557 and within file no. 9326/2026.

The measure derives from the Resolution of the delegated councillor for the control of concessions and contracts of September 3, 2026, no. 4423/2026, which agrees to resolve the contradictory administrative procedure for the extinction of funeral rights. The cause is that provided for in article 24.1.c) of the Regulatory Regulation of the public municipal cemetery service of Salou, due to non-payment of taxes for five consecutive years and the existence of an unsuccessful executive collection procedure.

In accordance with articles 23, 24.1.c) and 24.3 of the Regulation, the extinction of the funeral right and the reversion of the graves to the Salou City Council are declared, without prejudice to the continued collection of the outstanding amounts. The edict is signed by the general secretary Enric Ollé Bidó on September 10, 2026.

The nine affected holders

The extinguished funeral rights correspond to the following holders and graves:

Fifteen days to claim the remains

According to article 26.2 of the Regulation, interested parties have 15 business days from the notification to expressly request the location where they wish the existing remains to be transferred, assuming the corresponding expenses. If they do not do so, the remains will be exhumed and interred, in an individualized and identified manner, in the general ossuary.

Article 26.3 adds that, prior to exhumation, any person who proves kinship or emotional ties to the remains may claim them, also assuming the derived expenses. Regarding the removed ornamental elements, they will remain in municipal deposit for 30 days; after this period, any right to these elements will expire.

Appeals against the resolution

The resolution exhausts the administrative route. An administrative appeal may be filed against it before the Tarragona Court of First Instance, Administrative Litigation Section, within a period of two months, or, optionally, a motion for reconsideration before the same body within a period of one month. Both periods are counted from the day following the notification.

The publication affects nine families from Salou who may lose ownership of the niches and, if they do not act within the deadline, the location of the remains of their deceased. The edict also reminds that the extinction of the right does not cancel the debt: the City Council keeps the collection of pending amounts open.
