Salobre's Data Protection Delegate entrusts the Provincial Council

The Salobre City Council has entrusted the Provincial Council of Albacete with the exercise of the functions of Data Protection Officer, through a management entrustment agreement published in the Official Gazette of the Province of Albacete number 100, dated August 28, 2026, in the third section of Local Administration. The agreement, adopted by an absolute majority of the municipal Plenary on July 16, 2026, was accepted by the Provincial Council through Decree No. 3676, dated August 10, 2026.

A model of municipal cooperation

The entrustment is based on Article 34 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights, and Article 37 of Regulation (EU) 2016/679 (General Data Protection Regulation), which mandate the appointment of a Data Protection Officer. Article 36 of Law 7/1985, on the Bases of the Local Regime, enables Provincial Councils to provide legal, economic, and technical assistance and cooperation to municipalities, assuming these functions when they are entrusted to them.

The mechanism is supported by the agreement of the Plenary of the Provincial Council of May 8, 2019, which established a collaboration framework with municipalities for compliance with GDPR obligations, and Article 11 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector, which regulates the entrustment of management.

Signing parties

The agreement was signed by the following authorities:

  • Santiago Cabañero Masip, president of the Provincial Council of Albacete, assisted by the general secretary Francisco Suay Ojalvo.
  • Francisco Martínez García, mayor of the Salobre City Council, assisted by the municipal secretary Luis Ortega Romero.

Obligations and rights

The Provincial Council assumes the functions inherent to the Data Protection Officer through its Data Protection Unit, without prejudice to the ownership of the competence, which is retained by the City Council. The municipality must prepare its Record of Processing Activities on the electronic platform provided by the Provincial Council and request a favorable report from the Unit prior to its approval or rectification. In exchange, it has free access to the platform and may consult and request advice from the provincial Unit.

Validity and termination

The term of the agreement is 4 years, extendable by unanimous agreement of the parties for a period of up to 4 additional years. It shall be terminated by mutual agreement, by written notice from either party, or by revocation or waiver in the event of breaches, following a reasoned resolution and a hearing process. The agreement is administrative in nature, is governed by Law 40/2015, and assigns sole jurisdiction to the Contentious-Administrative Court of Albacete. It shall enter into force the day following its publication in the BOP, which is to be carried out by the Provincial Council.

The entrustment reinforces the model of provincial assistance to small municipalities, which thus avoid assuming alone the costs and technical specialization required for data protection, guaranteeing regulatory compliance with the support of the provincial structure.
