Salmerón approves the internal regulations ordinance for its Senior Housing facility

The Salmerón City Council has finalized the municipal Ordinance regulating the internal regime for the Salmerón Seniors’ Housing “Villa de Salmerón”, as no claims were submitted during the public exhibition period. The initial plenary agreement is thus automatically approved, and its full text is published in the Official Gazette of the Province of Guadalajara (BOP) No. 179, Monday, September 21, 2026, in the CITY COUNCILS section, pages 1 to 9. The resolution is signed by the mayor, Óscar Balcones Calvo, in Salmerón on September 16, 2026.
Legal framework and purpose of the service
The regulation is issued in compliance with Article 70.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and in exercise of the powers under Article 25 of the same law and Article 59 of Law 14/2010, of December 16, on Social Services of Castilla-La Mancha. Through this, the Salmerón City Council establishes the Municipal Social Service of the Care Center via Seniors’ Housing, the purpose of which is the temporary or permanent accommodation of independent elderly people who are homeless or in need of social coexistence incentives.
Furthermore, the text adapts the municipal regulation to Decree 2/2022, of January 18, which sets the basic conditions for specialized social service care centers for elderly people in Castilla-La Mancha. Residential care is aimed at those who do not have accommodation or, if they do, lack the necessary support to remain in it under adequate conditions of coexistence and safety.
Requirements, priorities, and management
User status is granted by the mayor following a mandatory report from the Assessment and Monitoring Commission, a collegiate body composed of two representatives from the City Council—the mayor, who presides over it, and one councilor—and two from the Provincial Delegation of Social Welfare (the head of the Specialized Social Programs section and the social worker of the PRAS area), with the Corporation’s secretary acting as secretary. Its functions include assessing the requirements of applicants, setting the initial fee, applying the sanctions regime, and agreeing on the loss of user status.
The access requirements are:
- Lacking a home of one’s own or being in need of a higher degree of coexistence and social care.
- Being a resident of Salmerón on a priority basis.
- Lacking a disability that prevents normal activity and coexistence and being declared fit for admission.
- Not suffering from an infectious-contagious disease.
The order of priority considers being over 60 years of age, proving residency in the municipality for more than six months, being homeless or having a home in poor condition, having a greater need for the service and lacking family members, and the date of submission of the applications. Petitions that meet the requirements but do not obtain a place will be placed on a waiting list and will be reviewed when a vacancy occurs. User status is lost by ceasing to meet the requirements, by sanction for a very serious infringement, by voluntary withdrawal, and by failure to pay two monthly installments, following a report from the Commission.
Duties, rights, fees, and sanctions
The ordinance details the duties of the users —respecting the convictions of other residents and staff, using the facilities correctly, paying the corresponding amounts, maintaining personal hygiene and the daily cleanliness of the bedroom, among others— and their rights, which include dignified treatment, confidentiality of information, maintenance of family ties, participation in activities and center management, and the reception of visitors. Users may approve their own coexistence rules by majority, and the person in charge of the housing will meet with them at least quarterly to validate the quality of the services.
Regarding economic matters, the ordinary residence fee is set at 75% of the beneficiary’s monthly net income, considering 14 payments in the case of receiving a subsidy or pension, with annual updates and payment via bank direct debit, respecting a minimum amount for personal expenses. Minor infringements are sanctioned with a warning; serious ones, with a warning and a fine of up to 10% of the applicable fee; and very serious ones may lead to the loss of user status, decreed by the mayor following a report from the Commission and a hearing for the interested party. The center’s staff is set at a minimum of 80 weekly hours of assistants when occupancy does not exceed seven users, adding 12 weekly hours for each additional resident, with at least three qualified assistants.
Entry into force and appeals
The ordinance repeals the Regulatory Ordinance of the “Villa de Salmerón” Elderly Housing Service published in the BOP no. 35, of March 23, 2015, and enters into force on the same day of its publication in the provincial bulletin, remaining in effect until its express modification or repeal. An administrative appeal may be filed against the agreement before the Administrative Chamber of the High Court of Justice of Castilla-La Mancha, based in Albacete, within two months from the day following the publication of the announcement, in accordance with Article 46 of Law 29/1998, of July 13.
The regulation provides an updated legal framework for Salmerón’s only public residential resource for the elderly, by establishing in writing who can gain access, how much they must pay, and the consequences of breaching the rules of coexistence. For the local residents, the text clarifies the selection criteria and the waiting list, while the residents gain an explicit catalog of rights and a formal channel for complaints and participation.
