Imminent ruin forces the demolition of a property in Valdemadera

The Valdemadera City Council has declared a state of imminent ruin for the property located at calle Medio, number 3, due to the certain risk of detachment and collapse of its structural elements onto the public road. The resolution, adopted by the Mayor’s Office on August 24, 2026, orders the owner to carry out the demolition within a period of seven calendar days and has been made public through collective notification in the Official Gazette of La Rioja (BOR) number 162, of August 25, 2026, page 14761.
The announcement, processed as imminent ruin declaration file number 110/2025, is published because it has not been possible to personally notify the title holders and heirs, who are unknown or whose whereabouts are ignored. In accordance with articles 44 and 46 of Law 39/2015, of October 1, on the Common Administrative Procedure, notification is carried out by edict in the BOR and in the Official State Gazette (BOE).
The demolition order
The resolution requires the owner, under their own responsibility and within a period of seven calendar days, to proceed with the demolition of the property, which must be directed by a competent technician and following the procurement of the relevant concurrent authorizations. The risk has been verified through reports from the Municipal Technical Services.
- Affected property: calle Medio, number 3, cadastral reference 6786512WM7468F0001BZ.
- Execution period: 7 calendar days.
- Direction of works: competent technician, with the necessary authorizations.
Subsidiary execution and costs
If, after the period has elapsed, the demolition has not begun nor has its technical impossibility been proven, the City Council will proceed with the subsidiary execution of the demolition at the expense of the obligated party, pursuant to article 102 of Law 39/2015. The amount of the demolition expenses, technical direction, and fees will be demanded via administrative enforcement, with the property itself being liable for the payment of said costs.
Given the urgency and the imminent risk to the safety of people and property, the Council has immediately adopted the precautionary measure of perimeter security fencing, the costs of which will likewise be charged to the property owners.
Appeals and consultation of the file
The complete administrative file is available to any interested party at the City Council offices, located at Alfonso Benito, 2, Aguilar del Río Alhama, during public office hours. Against the resolution, which ends the administrative route, the following may be filed:
- Optional Appeal for Reversal (Recurso de Reposición) before the same body, within one month from the date of publication in the BOE.
- Contentious-Administrative Appeal before the Contentious-Administrative Court of Logroño, within two months, in accordance with Law 29/1998, of July 13.
The resolution is signed by the Mayor-President, Ildefonso Fernández Muñoz, dated August 24, 2026. The measure seeks to avoid a structural collapse over the public road and protects the safety of the residents of Valdemadera, a small municipality in La Rioja, while the situation of a property whose owners could not be located is resolved.
