RTB fixed payment notices prescribed from 14 September 2026

The Residential Tenancies Board (RTB) will, from 14 September 2026, begin serving fixed payment notices under new prescribed forms set out in S.I. No. 435 of 2026, the Residential Tenancies Act 2004 (Prescribed Form) (No. 2) Regulations 2026. The instrument, published in Iris Oifigiúil on Friday, 21 August 2026, prescribes the notices the Board will use to enforce rent-setting and tenancy registration requirements.

The Regulations are made under the Residential Tenancies Act 2004, as amended, and prescribe fixed payment notices for the purposes of sections 12, 22B, 144 and 144A of that Act. They take effect on the same day that the main body of the Housing and Residential Tenancies (Miscellaneous Provisions) Act 2026 is brought into operation.

Commencement in tandem with the 2026 Act

The new notices coincide with S.I. No. 434 of 2026, the Housing and Residential Tenancies (Miscellaneous Provisions) Act 2026 (Commencement) (No. 2) Order 2026, also published in the same issue of Iris Oifigiúil. That Order appoints 14 September 2026 as the day on which a large block of sections of the 2026 Act — including sections 3, 18 to 39, 41 to 48, 51 to 55 and 57 to 61 — come into operation.

The two instruments are designed to work together, giving the RTB the procedural forms it needs to enforce the new rent-setting and tenancy registration obligations once the underlying provisions of the 2026 Act are live.

What the notices cover

The prescribed fixed payment notices are to be served by the Residential Tenancies Board to enforce two core areas of landlord and tenant law:

• Rent setting — enforcement of the rent-setting requirements under the amended Residential Tenancies Act 2004.
• Tenancy registration — enforcement of the obligation to register tenancies with the RTB.

The notices are prescribed for the purposes of sections 12, 22B, 144 and 144A of the Residential Tenancies Act 2004, as amended, which set out the relevant enforcement and penalty provisions.
