Rota approves the regulation on availability of its public employees.

The Plenary of the Rota City Council has definitively approved the Regulation on Availability for Public Employees, a voluntary scheme of extraordinary services that compensates municipal workers with amounts between 60 and 100 euros per month. The regulation is published in full in issue No. 154 of the Official Gazette of the Province of Cádiz, dated August 12, 2026, under reference No. 255.449. The same gazette opens to public display a new amendment to the regulation, under reference No. 255.743.

The agreement closes a procedure initiated on February 18, 2026, when the Plenary, in an ordinary session, initially approved the amendment of Article 13 and the consolidation of the text. After the correction of errors on March 18 and the public display announced in BOP issue No. 77, dated April 24, 2026, the corporation rejected the objections in the urgent extraordinary session of July 2 and gave final green light to the regulation, signed on July 30 by the acting deputy secretary, María Isabel García García. The regulation will enter into force on the day following its publication in the provincial gazette.

Eleven groups and voluntary adherence

Availability is defined as the obligation, voluntary and contractual, to be at the disposal of the Rota City Council to provide services outside the ordinary working day. Employees in the following groups may join:

  • Local Police, Civil Protection, events workers, janitors, library staff and processing clerks of the Citizen Attention Office;
  • electricians, master plumber, works foreman, municipal tow truck and parks and gardens.

The negotiating table may restrict or expand the list. Enrollment is formalized during the month of November through the contractual document in Annex 1 and binds for the entire following calendar year.

Obligations and call order

The employee must provide a telephone number to be reached between 9:00 a.m. and 10:00 p.m. and return the call within at most four hours. The Administration will communicate services with four calendar days’ notice, except in urgent cases, and a minimum rest period of eight hours between services is guaranteed. Call-outs are ordered first by signing date and then by lower number of accumulated hours and seniority. Holy Week and Spring Fair events are excluded from the scheme.

Compensation and monthly caps

Compensation is monthly and depends on the extraordinary service hours planned per department on an annual basis:

  • up to 1,000 hours: 60 euros per month;
  • more than 1,000 and up to 2,000 hours: 80 euros;
  • more than 2,000 hours: 100 euros.

The maximum monthly caps per department or group are 2,400, 3,500 and 5,000 euros depending on the bracket; if they are exceeded, the amount is distributed among those enrolled. In January of each year, the payroll is adjusted according to the hours actually worked.

Points, payroll deductions and sanctions

The sanctioning regime combines points and economic penalties:

  • not answering the phone or not returning the call: 2 points;
  • not reporting a change of number: 2 points, plus one additional if it persists for five days;
  • declining the assigned service: 3 points;
  • failing to appear for a confirmed service: 4 points.

Reaching two points in a calendar year means losing 100% of the monthly amount; with four points, the amount is lost and the employee is expelled from the scheme for the rest of the year. Medical leave that causes non-appearances entails the loss of 50% of the monthly payment. The sanctions, imposed by Decree of the Mayor-Presidency and immediately enforceable, are paid through payroll deduction, for which the employee signs their consent in the contractual document.

A modification, in public exhibition

Announcement No. 255.743 states that the Plenary, at the urgent extraordinary session of July 2, 2026, initially approved a modification of the regulation and its consolidation. The file will remain open for public inspection for thirty business days; if no objections are submitted, it will be finally approved. It can be consulted at the Department of Presidency and Human Resources (Plaza de España, 2, García Sánchez building, from 9:00 a.m. to 2:00 p.m.) and on the City Council’s Transparency Portal.

The regulation affects the municipal groups with the greatest burden of extraordinary services and establishes for the first time a monthly compensation with objective distribution and transparency criteria. For employees in Rota, knowing the points system, payroll deductions and the deadlines of the new public exhibition period is decisive before deciding whether to join the scheme starting next calendar year.
