The Single Registry of Solidarity Media Outlets is revoked due to overlapping competencies

Revocan el Registro Único de Medios de Comunicación Solidarios por duplicar competencias

The Special Administrative Unit of Solidarity Organizations fully revoked the Unique Registry of Solidarity Media (RUMS), created a year ago, considering that it duplicates sectoral competencies and generates unnecessary administrative burdens for the target organizations. The decision was recorded in Resolution number 167 of 2026, signed on August 26 and published in the Official Gazette number 53,622 on Thursday, September 10, 2026, page 35.

The measure was adopted by the Acting National Director of the entity, Yolanda Amaya Herrera, in exercise of the powers conferred by article 93 et seq. of Law 1437 of 2011 and Decree Law 4122 of 2011. This action nullifies Resolution number 239 of August 12, 2025, which had created the RUMS and established its definition, administration, registration requirements, benefits, and inter-institutional coordination mechanisms.

Reasons for the revocation

The legal and functional review of the registry evidenced that the RUMS was not conceived exclusively as an internal instrument for information, characterization, or institutional strengthening, but instead incorporated registration requirements, periodic monitoring and verification mechanisms, alert systems, strengthening plans, and provisions regarding the suspension or cancellation of registration.

According to the resolution, such components exceed the scope of a tool oriented toward information gathering and may generate overlap regarding the competencies attributed to the sectoral authorities in charge of the regulation, administration, surveillance, or control of communications activities. The coexistence of the RUMS with sectoral registries and mechanisms for information, authorization, and monitoring produces duplication in the provision and validation of data, as well as additional administrative burdens.

Invoked regulatory framework

The decision is based on several regulatory bodies that delimit the Unit’s competencies relative to special sectoral regimes:

  • Law 1341 of 2009, modified by Law 1978 of 2019, which sets the general framework for public policies in the Information and Communications Technologies sector.
  • The special regime for the public community sound broadcasting service, whose authorization, concession, and monitoring correspond to the ICT authorities.
  • Article 166 of Decree Law 019 of 2012, which provides for the integration of the registries of solidarity economy entities from Law 454 of 1998 into the Unique Business and Social Registry (RUES), administered by the Chambers of Commerce.
  • The principles of efficacy, economy, speed, coordination, and publicity of administrative functions provided for in article 3 of Law 1437 of 2011 and article 209 of the Political Constitution.

Revocation does not in itself entail the automatic revocation of individual administrative acts nor the affectation of legal situations consolidated during the validity of the registration. The Technical Development Directorate of the Unit must identify and verify the registrations, recognitions, or individual actions carried out based on Resolution 239 of 2025, to determine if individual and concrete legal situations derived from them.

The information collected on the occasion of the operation of the RUMS will be managed and preserved in accordance with the provisions on documentary management, transparency, access to public information, and protection of personal data. The Unit may continue to use this information for characterization, research, promotion, support, and strengthening activities for solidarity organizations, provided that it does not imply the exercise of competencies assigned to other authorities.

The resolution was communicated to the Ministry of Information and Communication Technologies and takes effect from its publication in the Official Gazette. For solidarity organizations that carry out communication activities, the measure eliminates a parallel procedure and reaffirms that their authorization and monitoring correspond to the already established sectoral regimes, without affecting the rights acquired during the validity of the registration.
