Subsidies for the scrapping of polluting vehicles revoked in the Balearic Islands

The Department of Business, Freelancers and Energy of the Government of the Balearic Islands has revoked a grant awarded for the scrapping of the most polluting vehicles within the framework of the tourist stay tax, due to non-compliance with the terms of the call. The decision, adopted by resolution of the counselor and signed in Palma on August 18, 2026, was published in the Official Gazette of the Balearic Islands (BOIB) no. 105 of August 22, 2026, in Section III, page 45816.

The resolution, identified by number 8469 and file ITS2024-2025-068, revokes the granting of the subsidy, authorizes the negative disposition of the expenditure, and declares the procedure concluded with the archiving of the file. The beneficiary must reimburse the amount received.

Background of the call

The public call for grants for the scrapping of the most polluting vehicles was approved by resolution of the counselor of Business, Freelancers and Energy on July 18, 2025, and was published in BOIB no. 96 on July 22, 2025. Management was the responsibility of the General Directorate of Circular Economy, Energy Transition and Climate Change, which granted the aid charged to the tourist stay tax and the measures to promote sustainable tourism.

After examining the supporting documentation, the technicians of the General Directorate issued an unfavorable report on the justification of the file. On April 7, 2026, the provisional resolution proposal was published in BOIB no. 47 on April 11, 2026, and the deadline for submitting allegations expired without any being presented.

The beneficiary and the reason for revocation

The revoked grant corresponds to a single beneficiary, with the following data:

The resolution is based on Law 38/2003, of November 17, general on subsidies; Royal Decree 887/2006, of July 21, which approves its Regulation; Legislative Decree 2/2005, of December 28, by which the Revised Text of the Subsidy Law of the Balearic Islands is approved; and the Order of the counselor of Commerce, Industry and Energy of May 15, 2008.

Appeals and closure

Against the resolution, which exhausts the administrative route, an optional appeal for reversal may be filed before the Minister of Business, Freelancers and Energy within one month, or a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of the Balearic Islands within two months. The resolution was signed on behalf of the Minister by the Director General of Circular Economy, Energy Transition and Climate Change, Diego Viu Domínguez, according to the delegation published in BOIB no. 97 of July 24, 2025.

The revocation demonstrates the control that the Balearic Administration exercises over aid financed by the tourist tax, and reminds beneficiaries that compliance with the time requirements of the call is an indispensable condition for maintaining the subsidy. The reimbursed amounts return to the budget item destined for sustainable tourism measures.
