Reocín approves the ordinance regulating the construction of outdoor swimming pools

The Reocín City Council has definitively approved the Municipal Ordinance regulating the Construction of Outdoor Swimming Pools, the full text of which is published in the Official Gazette of Cantabria number 171, dated September 4, 2026, with reference CVE-2026-6884. The regulation, processed under file 1447/2026, will enter into force fifteen business days after its publication.

The ordinance was initially approved by the Plenary in an extraordinary session held on July 1, 2026, following the incorporation of amendments formulated during the session itself. The file was subject to public information and a hearing for interested parties for thirty business days from the publication of the announcement in the Official Gazette of Cantabria number 134, dated July 14, 2026, without any claims or suggestions being presented. The provisional agreement was made definitive by Mayoral Decree number 2026-0420, dated August 28, 2026, signed by the mayor-president, Pablo Diestro Eguren, in Puente San Miguel.

Purpose and procedure

The ordinance regulates, within the urban planning scope of municipal competence, the regime applicable to the construction and installation of outdoor swimming pools throughout the municipality of Reocín. Both built-in and prefabricated pools will require the prior procurement of a municipal building permit, in accordance with article 233.1 of the Cantabria Law 5/2022, of July 15. The application must be accompanied by a technical project and the corresponding construction management, signed by a competent technician and endorsed by the corresponding Professional College.

Setbacks and rural land

The regulation establishes differentiated conditions according to the type of land and the typology of the pool:

• Fully buried pools: minimum setback of 2.0 meters from the outer perimeter of the pool shell to the plot boundary, provided that no element exceeds the theoretical envelope with a maximum slope of 100%.
• Raised pools or those exceeding the envelope: must respect the minimum setback established by the applicable municipal urban planning regulations.
• Auxiliary elements (pump houses, filtration and purification systems): shall maintain the same setbacks as the pools.
• Rural land: pools shall be located within the building’s movement area and their authorization shall comply with the procedure in article 228 of the Cantabria Law 5/2022.
• Housing linked to agricultural holdings: may not incorporate pools or sports facilities, in accordance with article 109 of the NUR.

General considerations

Removable swimming pools are considered garden furniture elements and shall not be subject to a municipal building permit. Community and public swimming pools must be processed in accordance with Royal Decree 72/2008, with a mandatory and binding report from the General Directorate of Public Health. Private-use pools on community land require authorization from the Community of Owners. The discharge of wastewater must comply with Decree 18/2009 of Cantabria, and the return of the deposit will require proof of the correct management of construction and demolition waste.

The ordinance, which shall remain in force until its express modification or repeal, directly affects property owners and developers in Reocín, who must adjust their projects to the new setbacks and documentary requirements. Against the agreement, which is final in administrative proceedings, a contentious-administrative appeal may be filed within two months before the Contentious-Administrative Chamber of the High Court of Justice of Cantabria.
