Rebolledo de la Torre approves the new water supply fee

The City Council of Rebolledo de la Torre has definitively approved the municipal ordinance regulating the fee for the provision of the water supply service, according to the Plenary agreement of February 18, 2026. The regulation, which affects all residents of the municipality, is published in the Official Gazette of the Province of Burgos number 161, dated August 26, 2026, with reference BOPBUR-2026-03573.

As no claims were filed during the public exhibition period, the initial plenary agreement was automatically elevated to definitive, and its full text is made public in compliance with article 70.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime.

Legal Basis and Scope of Application

The fee is established in exercise of the powers contained in articles 133.2 and 142 of the Spanish Constitution and in articles 105 and 106 of Law 7/1985, in accordance with article 20.4.t) and articles 15 to 19 of Royal Legislative Decree 2/2004, of March 5, which approves the revised text of the Law regulating Local Treasuries.

The taxable event consists of the administrative activity of providing the water supply service, including connection rights. The taxpayers are all natural and legal persons who request or benefit from the service, and the owners of the properties act as substitutes for the taxpayer, being able to pass the fees on to the beneficiaries.

Connection Fee and Consumption Rates

The fee for the granting of the license or authorization for connection to the water network is required as a one-time payment, as a fixed amount per dwelling or premises:

• Single-family homes, buildings, commercial or industrial premises, agricultural warehouses, and provisional connections: 320 euros.

The fee for the provision of the service is required semi-annually based on the cubic meters consumed, with the following rates:

• Domestic use: minimum of 90 m³/semester for 20 euros; from 90.01 to 120 m³, 0.50 euros/m³; over 120 m³, 0.60 euros/m³.
• Economic activity use (industrial and agricultural): minimum of 90 m³/semester for 20 euros; from 90.01 to 120 m³, 0.50 euros/m³; over 120 m³, 0.60 euros/m³.
• Livestock use: minimum of 800 m³/semester for 20 euros; over 800 m³/semester, 0.30 euros/m³.

Rebates, Accrual, and Sanctioning Regime

No exemptions are recognized except those provided for in regulations with the rank of law. However, up to 90% of the tax quota may be rebated, upon request by the user, in cases of a sufficiently demonstrated leak in the private network without negligence on their part, with the mayor resolving the request based on the evidence.

The fee accrues from the start of the service provision, either upon the submission of the supply request or when the municipal service is established and operational. Payment is made via a receipt derived from the registration, and anyone requesting removal from the census must re-register and pay the connection fee to restart the service. Regarding infractions and sanctions, Law 58/2003, of December 17, General Tax Law, shall apply.

Appeal and Entry into Force

An administrative-law appeal may be filed against the agreement before the Administrative Chamber of the High Court of Justice within two months from the day following the publication of the announcement, in accordance with Article 46 of Law 29/1998, of July 13, of the Administrative-Law Jurisdiction. The agreement is dated August 13, 2026, and is signed by the mayor, Raúl Báscones Moisén.

The new ordinance provides the municipality with a clear and updated tariff framework for the water supply, with a single connection fee and progressive consumption rates that distinguish between domestic, economic, and livestock uses. Its final approval represents a direct change in the bills of all residents of Rebolledo de la Torre, who must take into account the new semi-annual quotas and the 320-euro fee for new connections.
