Repatriation of Indochinese returnees: lump-sum compensation and the national day of June 8th
Por FactBox Admin

The Nation recognizes its responsibility for the indignity of the reception and living conditions imposed on repatriates from Indochina on French territory, and grants them the right to a lump-sum financial reparation. This recognition is set out in Law No. 2026-1008 of October 29, 2026, signed on October 29 and published in JORF No. 0254 of October 30, 2026, under NOR: ARMX2516107L. The text, which consists of seven articles, also establishes a national day of tribute and sites of remembrance.
The mechanism stems from a legislative proposal adopted by the National Assembly (No. 685, 2024-2025). In the Senate, the Social Affairs Committee was seized of the matter on its merits, with Jocelyne Guidez as rapporteur; her report and text (No. 65 and No. 66, 2026-2027) were filed in mid-October, prior to the final adoption of the text.
The reference period adopted by the law is precise: it runs from July 22, 1954, the day after the Geneva Accords which ended the Indochina War, to December 31, 1975. It thus covers more than twenty years of reception for repatriates—military personnel, members of supplementary formations, public officials, and civilians, as well as their families.
A recognition targeting reception structures
Article 1 first expresses the Nation’s recognition toward military repatriates, former members of supplementary formations, and public officials who served France in Indochina. The second paragraph takes a further step: the State recognizes its responsibility for the indignity of the reception of repatriated civilians and their families, “housed in structures of all kinds” where they endured particularly precarious living conditions.
The text explicitly describes these deprivations and infringements on individual liberties as sources of exclusion, suffering, and “lasting traumas across generations.” The list of affected structures is not fixed by the law itself: it refers to a decree.
A lump sum based on the duration of stay
Article 3 opens reparations to the persons referred to in the second paragraph of Article 1 who stayed, between July 22, 1954, and December 31, 1975, in one of the reception structures listed by decree.
- The reparation takes the form of a lump sum.
- Its amount takes into account the duration of the stay.
- The payment conditions and the scale will be determined by decree.
- This amount is deemed to cover damages of all kinds suffered as a result of this stay.
Article 4 entrusts the investigation and adjudication of claims to the authority already competent for military invalidity pensions, by adding a 3° ter to Article L. 611-5 of the code des pensions militaires d’invalidité et des victimes de guerre (Code of Military Invalidity Pensions and War Victims).
June 8, Noyant-d’Allier and Sainte-Livrade-sur-Lot
Article 2 establishes a national day of remembrance for those who died for France in Indochina, for the combatants, members of supplementary units, and repatriates. It also honors those who provided assistance during repatriation and reception. The date is set for June 8.
The same article provides for sites of memory, “particularly in Noyant-d’Allier and Sainte-Livrade-sur-Lot” — two municipalities that hosted repatriation accommodation centers. The complete list and the implementation procedures will be determined by decree.
Tax-exempt compensation, funded by tobacco
Articles 5 and 6 secure the tax regime of the sum paid. It is exempt from income tax, through the insertion of a “d bis” in 4° of Article 81 of the general tax code, and excluded from the basis of social security contributions referred to in Article L. 136-1-3 of the social security code.
Article 7 organizes the financial compensation: the cost to the State and the loss of revenue, including for social security organizations, are covered by an additional excise tax on tobacco.
For the families concerned, the essential parts are yet to come: the decree must establish the list of structures, the scale, and the procedures for submitting applications. The law establishes the principle of reparation and recognition, but the amount actually paid will depend on this implementing text, as will the concrete scope of the June 8 remembrance day and the sites of memory.
