The King promulgated, on August 27, 2026, a law amending the law on compulsory health care insurance and benefits, coordinated on July 14, 1994, regarding medical evaluation and control. The text is published in the Belgian Official Gazette (Moniteur belge) no. 207 of September 14, 2026, page 49831, under reference C-2026/006574. It was signed by King PHILIPPE, countersigned by the Minister of Social Affairs and Public Health, F. Vandenbroucke, and sealed by the Minister of Justice, A. Verlinden.

A targeted amendment to the coordinated law of 1994

The new law falls within the framework of the coordinated law of July 14, 1994, relating to compulsory health care insurance and benefits, of which it modifies the medical evaluation and control mechanism. It was adopted by the Chambers following a parliamentary examination, the documents of which are referenced under number 56K1620/6 at the House of Representatives (full report of August 4, 2026) and under number 8-224/(2025/2026) at the Senate, where the project was not discussed.

The text consists of two chapters:

  • a Chapter 1 (introductory provision) specifying that the law regulates a matter referred to in Article 78 of the Constitution;
  • a Chapter 2 (amendment of the coordinated law of 1994) dedicated to medical evaluation and control.

The repeal of the last sentence of Article 145

Article 2 of the law amends Article 145, § 1, paragraph 1 of the coordinated law of July 14, 1994, as last amended by the law of November 6, 2023. The amendment consists of repealing the last sentence of this paragraph, which frames medical evaluation and control within the compulsory insurance scheme.

This provision directly affects the functioning of the medical control exercised over health care benefits and allowances, the organization of which is entrusted to the insurance bodies and the competent control services. The repeal of this sentence aims to adapt the legal framework for medical evaluation.

Scope for the insured and insurance bodies

The reform primarily concerns insurance bodies and medical control services, which see the framework of their evaluation and control missions adjusted. For the insured, the amendment is part of the continuity of the compulsory health care insurance and benefits scheme, and does not challenge its general principles of coverage.

The text was promulgated in Brussels on August 27, 2026, and published in the Belgian Official Gazette of September 14, 2026, No. 207, page 49831, under reference C-2026/006574. It enters into force in accordance with the publication rules for federal laws, and its execution is entrusted to the Minister of Social Affairs and Public Health.
