Purullena delegates municipal waste collection to the Provincial Council

The Plenary of the Purullena City Council has unanimously approved to delegate to the Provincial Council of Granada the provision of the essential public service of collection and transport of municipal waste, under the separate collection modality (option B). The agreement, signed by Mayor José Luis Martínez Alcalde, is published in the Official Gazette of the Province of Granada number 169, dated September 2, 2026, with reference BOP-GRA-2026-169011.

The delegation is framed within the plenary agreement of the Provincial Council of Granada of September 25, 2025, which arranged for the coordination of the municipal solid waste collection service, and in the Regulatory Ordinance for the Provision of the Municipal Waste Collection Service, published in BOP No. 198 on 10/17/2025. Article 1.1 establishes that the Provincial Council coordinates the provision of the service in the municipalities that request it through a delegation of competence, which includes not only the material provision but also the powers of regulation, organization, management, and sanctioning.

An agreement that is corrected and revalidated

The agreement is not new: it was initially approved in the extraordinary plenary session of January 29, 2026, and published in BOP No. 65 on April 8, 2026. After an error was detected, it was approved again on April 22, 2026, and published in BOP No. 96 on May 21, 2026.

Subsequently, via entry E-RC-1269 of July 8, 2026, the Provincial Council of Granada communicated that the simultaneous inclusion of modalities B and C for the provision of the service is incompatible, therefore requiring a new plenary agreement that expressly and unequivocally determined the chosen modality. The Plenary of Purullena opted for option B, adjusting to the model approved by the Governing Board of the Provincial Council.

Option B: separate collection

The delegation refers to option B of the fourth clause, in accordance with article 11 of the Regulatory Ordinance, which outlines the types of services. Through this, the Provincial Council of Granada will exercise the competencies for the provision of the service with indefinite temporal validity, once the necessary files are completed, especially that of the service contracting.

The delegation grants the Provincial Council the powers inherent to the public service:

• Regulatory and self-organization powers.
• Programming or planning power.
• Expropriation powers and powers of investigation, demarcation, and official recovery of its assets.
• Presumption of legitimacy and enforceability of its acts.

Effective cost and specific fee

Pursuant to Article 26.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, the Provincial Council shall charge the City Council the actual cost of the service based on its use. The cost shall be determined quarterly by the Provincial Waste Collection Service, multiplying the tons collected by the cost per ton, with subsequent regularization.

The City Council shall collect the fee, without prejudice to the possible delegation of collection to the Provincial Tax Service, and shall pay the full amount of the settlements to the Provincial Council. Furthermore, pursuant to Article 11.3 of Law 7/2022, of April 8, on waste and contaminated soils for a circular economy, Purullena undertakes to maintain in force a specific, differentiated, and non-deficit fee that allows for the implementation of pay-as-you-throw systems and includes the actual cost of collection and transport operations.

Validity and Revocation

The agreement shall enter into force on the day following its publication in the Official Gazette of the Province of Granada. The City Council may only revoke the delegation if it justifies to the Provincial Council that it can provide the service at a lower actual cost, and must reimburse the expenses incurred, including compensation to the contractor.

The delegation represents a significant change for the residents of Purullena, who will see their waste collection managed by the provincial service and a waste fee adjusted to the actual cost of the service, in line with circular economy regulations.
