Publicado el II convenio colectivo de Fábrica Jaén S.L.U. para 2024-2028

The Official Gazette of the Province of Jaén, in issue number 177 on Friday, September 11, 2026, publishes the II Collective Agreement of Fábrica Jaén S.L.U., of company-wide scope, following its registration in the Registry of Collective Agreements of the Territorial Delegation of Employment, Enterprise, and Self-Employment of Jaén. The text, signed by the Negotiating Commission on May 8, 2025, and definitively corrected on September 3, 2026, regulates the labor and salary conditions for the entire workforce of the Jaén work center.

The publication is carried out via an edict from the Ministry of Employment, Enterprise, and Self-Employment of the Regional Government of Andalusia, signed by the Territorial Delegate Francisco Javier Carazo Carazo on September 4, 2026, and by the Head of the Labor Administration Service, Manuel Jesús Colmenero López, on September 8, 2026. The agreement is processed under file 23/01/0078/2026 and agreement code 23101922012023, within the framework of Article 90 of Royal Legislative Decree 2/2015 (Workers’ Statute) and Royal Decree 713/2010, regarding the registration and deposit of collective agreements.

Validity and scope of application

The agreement comes into effect on January 1, 2024, and ends on December 31, 2028, automatically and without the need for notice of termination. It expressly replaces previous agreements and individual or collective pacts, maintaining the most beneficial conditions recognized on a personal basis.

  • It affects all personnel registered at Fábrica Jaén S.L.U.: executives, middle management, and direct and indirect labor.
  • It is structured into three professional groups: Direct Labor (MOD), Indirect Labor (MOI), and Structure.
  • A Joint Commission is created as an interpretation and oversight body, with three members from each party and mediation by SERCLA in case of discrepancy.

Working day, shifts, and remuneration

The maximum full-time working day is set at 1,776 annual hours for each year of validity, with shift systems of five, six, or seven days per week, and breaks of 12 hours between working days and 36 hours per week. Mandatory special shifts are provided for key positions such as mixer, oven operator, machinist, laminator, miller, and robot operator.

  • Annual salary increases: 3% in 2024, 2.5% in 2025, 3% in 2026, 2% in 2027, and 2% in 2028.
  • Review clause: 0.50% for 2024-2025 and 0.75% for 2026-2028 if the CPI exceeds the agreed percentages.
  • Annual incentives: individual absenteeism of €500 (2024) and €600 (2025-2028), quality of €350, and accident rate of €50.
  • Night shift premium of 35% of the base salary for work between 10 p.m. and 6 a.m., and temporary disability supplements up to 100% of the regulatory base.

Social commitments and protocols

The agreement incorporates a protocol for action against harassment and violence against LGBTI people, with zero tolerance and a procedure for reporting, investigation, and resolution within fixed timeframes. It also includes the company’s commitment to occupational risk prevention, equality, and environmental protection, as well as a reference to the State Framework Agreement for Pastry, Confectionery, Bakery, Artisan Ice Cream, and Prepared Meals as the subsidiary regulation regarding hiring.

Relevance for the workforce

Publication in the official bulletin provides publicity and regulatory effectiveness to the company’s second agreement, providing legal certainty to the conditions agreed upon for the coming years. For the workers at the Jaén center, it means the consolidation of predictable salary increases, incentives linked to absenteeism, quality, and safety, and the guarantee of protocols against harassment, within a stable collective bargaining framework until 2028.
